(RMB/m2/月);The Ninth Lease Year: RMB Yuan per square meter per month (RMB_/m2/month)。第十個(gè)租約年至第十一個(gè)租約年的租金為每月每平方米人民幣 二十八元零八分();The Tenth Lease Year through the Eleventh Lease Year: RMB Twenty Eight point zero Eight Yuan per square meter per month (RMB )。第十一個(gè)租約年的租金為每月每平方米人民幣(RMB/m2/月);The Eleventh Lease Year: RMB Yuan per square meter per month (RMB_/m2/month)。第十二個(gè)租約年至第十三個(gè)租約年的租金為每月每平方米人民幣二十九元二角();The Twelfth Lease Year through the Thirteenth Lease Year: RMB Twenty Nine point TwoYuan per square meter per month ()。第十三個(gè)租約年的租金為每月每平方米人民幣(RMB/m2/月);The Thirteenth Lease Year: RMB Yuan per square meter per month (RMB_/m2/month)。第十四個(gè)租約年第十五個(gè)租約年的租金為每月每平方米人民幣三十元零三角七分();The Fourteenth Lease Year through the Fifteenth Lease Year: RMB Thirty point Three Seven Yuan per square meter per month ()。第十五個(gè)租約年的租金為每月每平方米人民幣(RMB/m2/月)。The Fifteenth Lease Year: RMB Yuan per square meter per month (RMB/m2/month). 租金支付日期及發(fā)票 Date of Payment of Rent and Invoice 租金應(yīng)在每月的第十(10)日或之前支付(遇中國(guó)的法定節(jié)假日時(shí)順延)。如果租期的開始日不是一個(gè)公歷月的第一天或租期終止日不是一個(gè)公歷月的最后一天,則第一個(gè)月或最后一個(gè)月的租金應(yīng)按實(shí)際租賃天數(shù)占該月總天數(shù)的比例計(jì)算,且第一個(gè)月的租金應(yīng)于第一個(gè)租約年的開始日后的十(10)日內(nèi)支付。甲方應(yīng)在每月第七(7)日或之前向乙方提供符合中國(guó)法律規(guī)定和稅務(wù)行政主管部門要求的正式租金發(fā)票(第一個(gè)月的租金發(fā)票應(yīng)于第一個(gè)租約年的開始日后的七(7)日內(nèi)提供給乙方)。The Rent will be paid on or before the Tenth (10th) day of each month (such day will be automatically extended for Chinese statutory holiday). If the Commencement Date of the Term does not fall on the first day of a month, or the ending date of the Term does not fall on the last day of a month, the Rent for the first month or for the last month will be calculated pro rata on a daily basis for the actual leasing day(s) in that month. The Rent of the first month will be paid within Ten (10) days following the Commencement Date. Party A will issue an official leasing invoice, which is valid under PRC law and conforming with the requirements of PRC tax authority, to Party B on or before the Seventh (7th) day of each month (the official leasing invoice for the first month will be provided to Party B within Seven (7) days following the Commencement Date of the first Lease Year), and the amount invoice will be equal to that of the Rent that Party B will pay for that month according to Article and this first paragraph of Article of this Agreement. 甲乙雙方在此確認(rèn),甲方對(duì)于該義務(wù)的違反將構(gòu)成其在本協(xié)議項(xiàng)下的嚴(yán)重違約。,甲方同意,乙方有權(quán)于未取得租金發(fā)票的次月起從應(yīng)付租金中扣除因甲方未能按本條要求向乙方提供租金發(fā)票而可能使乙方遭受的稅務(wù)損失后將應(yīng)付租金的余額支付給甲方,稅務(wù)損失金額計(jì)算方式為以甲方未能提供正式租金發(fā)票的租金金額乘以租賃標(biāo)的物所在地的所得稅稅率(“稅務(wù)損失金額”)。若甲方能在當(dāng)期公歷年結(jié)束前(即12月31日前)向乙方提供其拖欠的租金發(fā)票,則乙方應(yīng)在收到前述租金發(fā)票后十(10)日內(nèi)將乙方該年已扣除的相當(dāng)于稅務(wù)損失金額的款項(xiàng)無息退還給甲方,乙方無需向甲方支付任何滯納金。若甲方未能在當(dāng)期公歷年結(jié)束前(即12月31日前)向乙方提供其拖欠的租金發(fā)票,則乙方該年已扣除的稅務(wù)損失金額將被作為甲方支付的違約金,不再退還甲方。The Parties agree that Party A’s obligation to provide Party B with a valid leasing invoice under this Article is an essential obligation of Party A under this Agreement. Breach of this obligation by Party A will be regarded as a material breach of this Agreement. If Party A fails to provide a valid leasing invoice satisfying the requirement set forth in this Article , Party A agrees that Party B is entitled to deduct the tax loss that Party B may suffer due to Party A’s failure to provide the valid leasing invoice stipulated in this Article from the Rent due and payable for next month, and then pay the remainder of the Rent due to Party A. The loss of tax will be calculated as follows: amount of Rent for which Party A fails to provide leasing invoice multiplied by the ine tax rate of the locality (the “Tax Loss”). If Party A provides the outstanding leasing invoice to Party B before the end of the thencurrent calendar year, ., December 31st of the then current calendar year, Party B will pay to Party A, within Ten (10) days following its receiving the outstanding leasing invoice from Party A, the amount equal to the Tax Loss already deducted without any interest. Further, Party B will not be liable for paying any overdue fine for this loss. If Party A fails to provide the outstanding leasing invoice to Party B before the end of the thencurrent calendar year, ., December 31st of the then current calendar year, the Tax Loss deducted by Party B will bee the breach fee and will not be refunded to Party A. 水費(fèi)、電費(fèi)、燃?xì)赓M(fèi)及其發(fā)票Charges of Water, Electricity, Gas and Related Invoices 至遲于房屋內(nèi)乙方購(gòu)物廣場(chǎng)開業(yè)日的前三十四十五(3045)個(gè)工作日,甲方應(yīng)為乙方在供電、供水及燃?xì)饨?jīng)營(yíng)機(jī)構(gòu)完成單獨(dú)立戶并承擔(dān)與立戶相關(guān)的經(jīng)營(yíng)機(jī)構(gòu)收費(fèi)(若有該等收費(fèi))。自立戶之日起至租期屆滿止,乙方在租用面積內(nèi)的水(含空調(diào)用水)、電(含空調(diào)用電)、燃?xì)赓M(fèi)按其實(shí)際用量,單獨(dú)計(jì)量,自行向相關(guān)經(jīng)營(yíng)機(jī)構(gòu)繳納。At least ThirtyFortyFive (3045) working days immediately prior to the Grand Opening Day of Party B’s Supercenter within the Premises, Party A will apply for accounts with the relevant electricity, water, and gas service suppliers on behalf of Party B and bear all the account application expenses paid to the relevant utility suppliers (if there is any such fee). Under no circumstances will the executions of the contracts by and between Party B, and the relevant suppliers be viewed as an alteration on Party A’s rights and liabilities of electricity, water, and gas supplying facilities under this Agreement.
