【正文】 ause (Variation Procedure).If a proposal, which is approved by the Engineer, includes a change in the design of part of the Permanent Works, then unless otherwise agreed by both Parties: (a) the Contractor shall design this part,(b) Subparagraphs (a) to (d) of SubClause (Contractor’s General Obligations ) shall apply, and (c) if this change results in a reduction in the contract value of this part, the Engineer shall proceed in accordance with SubClause (Determinations) to agree or determine a fee, which shall be included in the Contract Price. This fee shall be half (50%) of the difference between the following amounts: (i) such reduction in contract value, resulting from the change, excluding adjustment under SubClause (Adjustments for Changes in Cost), and (ii) the reduction (if any) in the value to the Employer of the varied works, taking account of any reductions in quality, anticipated life or operational efficiencies. However, if amount (i) is less than amount (ii), there shall not be a fee.風(fēng)險分析：本條款為“價值工程”，是在新版FIDIC合同中新加入的條款，有利于承包商的利益，但是涉及到承包商運用增加建議法進(jìn)行報價，需要承包商有很高的資質(zhì)進(jìn)行報價，承包商在其中可以得到相應(yīng)的利益，業(yè)主也可以獲得應(yīng)得的報酬，這是一個雙贏的條款。 Variation Procedure在此條款中缺少下面的內(nèi)容：A description of the proposed work to be performed and a programme for its execution.風(fēng)險分析：在本條款中，當(dāng)工程師要求承包商提交變更前的建議書時，在FIDIC合同中規(guī)定應(yīng)該有以下內(nèi)容：(a) 將要實施的工作的說明書以及該工作實施的進(jìn)度計劃，(b) ，及(c) 承包商對變更估價的建議書。但是，在本條款中缺少（a）條內(nèi)容，則說明承包商可以少做一項工作，但是當(dāng)出現(xiàn)問題時是否可以免除自己的責(zé)任，那就要看雙方的協(xié)商了。 Daywork For work of a minor or incidental nature, the Engineer may instruct that a Variation shall be executed on a daywork basis. The work shall then be valued in accordance with the Daywork Schedule included in the Contract, and the following procedure shall apply. If a Daywork Schedule is not included in the Contract, this SubClause shall not apply. Before ordering Goods for he work, the Contractor shall submit quotations to the Engineer. When applying for payment, the Contractor shall submit invoices, vouchers and accounts or receipts for any Goods. Except for any items for which the Daywork Schedule specifies that payment Is not due, the Contractor shall deliver each days to the Engineer accurate statements in duplicate which shall include the following details of the resources used in executing the previous day’s work:(a) the names, occupations and time f Contractor’s Personnel,(b) the identification, type and time of Contractor’s Equipment and Temporary Works and(c) the quantities and types of Plant and Materials used.One copy of each statement will, if correct, or when agreed, be signed by the Engineer and returned to the Contractor. The Contractor shall then submit priced statements of these resources to the Engineer, prior to their inclusion in the next Statement under SubClause (Application for Interim Payment Certificates).風(fēng)險分析：在此條款中，如果進(jìn)行一些零星的工作時，工程師可以在原有的計日工的報價上進(jìn)行任何的變動，只要是雙方認(rèn)可的就是有效的，此外，對于承包商而言，進(jìn)行計日工報價的項目越多，自己的盈利就越多，所以為了盈利，承包商可以運用合理的手段和方法，盡可能多的獲得計日工報價的項目。 Advance Payment The Employer shall make an advance payment, as an interestfree loan for mobilization, when the Contractor submits a guarantee in accordance with the SubClause. The total advance payment, the number and timing of instalments (if more than one), and the applicable currencies and proportions, shall be as stated in the Appendix to Tender. In this event, the engineer shall give notice to the Contractor accordingly.風(fēng)險分析：在此條款中，承包商應(yīng)該注意的在投標(biāo)附錄中規(guī)定的最低支付限額是多少，在向業(yè)主或者工程師提出支付申請的時，要注意自己的凈金額是否低于最低支付金額，所以承包商在支付的時候要把握適當(dāng)，不然可能得不到支付款額，而影響了自己的資金流動或者是工程的施工；如果承包商要打“擦邊球”就一定要把握好自己的尺度，否則自己的風(fēng)險就會增加。 Statement at CompletionWithin 84 days after receiving the TakingOver Certificate for the Works, the Contractor shall submit to the Engineer six copies of a Statement at pletion with supporting documents, in accordance with SubClause (Application for Interim Payment Certificates), showing: (a) the value of all work done in accordance with the Contractor up to the date stated in the Taking Over Certificate for the Works,(a) any further sums which the Contractor considers to be due, and(b) an estimate of any other amounts which the Contractor considers will bee due to him under the Contract. Estimated amounts shall be shown separately in this Statement at pletion.
