【正文】 收到全部已經(jīng)買方承兌和我行背書(shū)保證的遠(yuǎn)期匯票之日終止。英譯：This letter of Guarantee will e into force from this day and will lose its effect when your pany has received all the usance drafts accepted by the Buyer and endorsed by our Bank.分析：法律文書(shū)中表示義務(wù)或規(guī)定時(shí)，第三人稱后面要用 “shall”不用 “will”. “from this day”不確切，宜改為 “on its issuing draft”。 “will lose its effect”也用得欠妥， “effect”在這里的含義是“效應(yīng)、結(jié)果”；況且此句的關(guān)鍵內(nèi)容是指“有效期到何時(shí)終止”，故應(yīng)選擇 “remain valid until…” 結(jié)構(gòu)；另外“your pany” 宜改為“you”。故后面的這一句應(yīng)譯成： “…shall remain valid until you have received all the usance drafts accepted by the Buyer and endorsed by our Bank”.例五：本細(xì)則的解釋權(quán)，屬于中華人民共和國(guó)財(cái)政部。英譯：The right of interpretation for the Detailed Rules and Regulations belongs to the Ministry of Finance of the People’s Republic of China.分析：“the right of interpretation for the Detailed Rules and Regulations”不能準(zhǔn)確地表達(dá)出“解釋細(xì)則的權(quán)利”，應(yīng)改為 “the right of interpreting the Detailed Rules and Regulations”。句中謂語(yǔ)動(dòng)詞 “belong to” 也用得欠妥：“belong to” 的含義是“屬于…的財(cái)產(chǎn)”，這里的“屬于”是指“權(quán)利、權(quán)力等為 ….所有”，故應(yīng)選用 “reside in ”，如：“決定權(quán)屬于上級(jí)機(jī)構(gòu)”，譯為：“The power of decision resides in the higher authorities”.結(jié)束語(yǔ)法律文書(shū)漢英翻譯涉及的問(wèn)題很多，但最重要的問(wèn)題乃是理解和表達(dá)。在英譯法律文書(shū)的過(guò)程中，譯者必須深入理解原文中的每個(gè)詞語(yǔ)在具體上下文中的含義，著重領(lǐng)會(huì)法律文件語(yǔ)言的確切性；在表達(dá)時(shí)，要對(duì)每個(gè)經(jīng)過(guò)挑選的英文詞、句進(jìn)行仔細(xì)推敲，選擇出最確切的表達(dá)方式。當(dāng)然，表達(dá)也應(yīng)該有一個(gè)逐步完善的過(guò)程，切不可一拿到文件就動(dòng)筆翻譯，這樣很難保證譯文的質(zhì)量。譯者在翻譯時(shí)，一定要不厭其煩地勤查專業(yè)工具書(shū)，對(duì)譯文一改再改，使其達(dá)到嚴(yán)謹(jǐn)、準(zhǔn)確、規(guī)范。6
