【正文】 ntracts,the formal ones are not marked with words in pair.In both the two samples,none of the phrases are posed of two or more synonyms or near synonyms.I have read quite a few other formal contracts and paid special attention to the words in pair,but I could detect almost none of them.The change may arise out of two considerations. One is that synonyms arenot as words of the same meaning but as‘closely allied ’words between which there are nice shades of distinction.The other is that in order to be concise,eye a formal contract should avoid using paired synonyms.6. Complicated and Strict Expression The formal contracts carry forwards the feature of plicated and strict expressions of the traditional contracts.In Sample Three,there arethe warehouse or place of storage,transit including sea,land and inland waterway transits and transits in lighter andfor allocation or distribution of the goods or for storage.In Sample Four,a good example isno claim or allegation shall be made against any Person whomsoever by whom the carriage is performed or undertaken(including all subcontractors of the carrier)other than the carrier,which imposes or attempts to impose upon any such personer any vessel. Contract After a glance at the two samples,we are impressed by the manifestly different linguostylistics of the modem contracts from those of traditional and formal ones. of Lingual Styles of Modem Contract Sentences For one thing,the length of a sentence,the modern contracts employ mostly short sentences.In Sample Five,there are six sentences.The longest holds 27words while the shortest one acmodates only 12 words.The average length of a sentence in it is almost exactly 17 words and the same as the average length of an English sentence in general.Sample Six prises five sentences.The first sentence,and the longest sentence as well,contains 30 words,hut the shortest one has only 5 words.The length of the sentence on average is less than 13 words. Punctuation As for the matter of punctuation,simply looking at the two samples.We can see that the modern contracts are fully punctuated and may permit of any punctuation with the exception of question marks and ellipses.In this respect they are similar tothe formal contracts but different from the traditional ones. Paired Words and Complicated and Strict Expressions In both the samples and in a number of the modern contracts I have read,there are hardly any words and expressions that are often encountered pair and plicated and strict in reading the traditional and formal contracts.The structure of a sentence in the modern contract is simple and easy to understand.I once asked a Chinese student who is studying in a junior middle school to read the contract which Sample Six was taken from,and he could understand it to a satisfactory extent except for some new words. of Descriptive Adjectives and Adverbs The modern contracts even make a concession to some descriptive and flubjective adjectives and adverbs which are never,at lea8t 8eldom.seen in the traditional and formal contracts.Just in the two contracts of which the two samples are parts we can spotfriendly.conscientiou1y,strictly,necessary,acceptableand kindly.Thesewords help to change the rigorous,objective and cautious tone of the traditional and formal contract in to the relatively trustful.subjective and humane tone of the modern contracts.6.
