淺析我國(guó)刑事量刑規(guī)范化的實(shí)施畢業(yè)論-資料下載頁(yè)

【正文】 訴機(jī)關(guān)行使量刑建議權(quán)問(wèn)題，我認(rèn)為公訴機(jī)關(guān)的量刑建議不應(yīng)隨起訴書(shū)一起提交人民法院，而是在經(jīng)過(guò)法庭調(diào)查和辯論之后，根據(jù)所查明的犯罪事實(shí)后在量刑辯論程序中提出。當(dāng)然這需要檢察官有扎實(shí)的業(yè)務(wù)素質(zhì)和靈活的應(yīng)變技巧，給檢察官提出了更高的要求。此外檢查機(jī)關(guān)要在形式量刑規(guī)范化過(guò)程中發(fā)揮好監(jiān)督作用，對(duì)人名法院的量刑活動(dòng)進(jìn)行監(jiān)督和審查，糾正可能出現(xiàn)的量刑錯(cuò)誤。具體而言，首先檢查機(jī)關(guān)要法院部門出臺(tái)的規(guī)范量刑指導(dǎo)性文件相關(guān)程序的合法性和正當(dāng)性進(jìn)行監(jiān)督。其次兩院要加強(qiáng)交流與溝通，避免法檢兩家由于認(rèn)識(shí)上的不統(tǒng)一而造成的沖突和矛盾的發(fā)生。 我們堅(jiān)信前途是光明的，我們能克服當(dāng)前刑事量刑規(guī)范化改革所面臨的難題，刑事量刑規(guī)范化改革能過(guò)促使我國(guó)實(shí)現(xiàn)真正的司法公正。Abstract: Activities of criminal judgment contain two aspects: conviction and measurement of penalty. It is the necessary requirement that convict correctly and measure properly. With the prehensive development of measurement of penalty in our country, it bees the problem which we should pay more attention to, which if we can change a judge abuse the right of administrative discretion, measurement is not normative and not balance. This paper aims to analyze problems in measurement of penalty and elucidate the meaning of carrying into measurement of penalty. Meantime, this paper will discuss problems and blocks in carrying into measurement of penalty in our country, and then we can find the stimulative and perfect measures of carrying into measurement of penalty in our country.
