Smoking, using open fire in the forbidden areas, spitting. 5. Entering and leaving the pany from nondesignated entrances and exits. 6. Organizing or participating any activities such as gathering, promotion, donation, etc without the clear authorization of pany leader. 7. Receiving the visitor unrelated to work without ratification. 8. Undertaking parttime or profitmaking activities outside the pany without the permission of the pany. 9. Not wearing pany card or losing it. Article 48: In any one of the following cases, the employee shall receive second grade punishment, which includes: Written Warning Letter, degradation, Fine of 20% monthly salary for 2 consecutive months. 1. Repetition of actions taken in the first grade punishment within 3 months. 2. Concealing the errors made in work, cheating, irresponsible actions in work which leads to the loss to the pany. 3. Late ing, early leaving, and absence for more than one working day without going through the stipulated procedures. 4. Breaching the safety operation stipulation, negligence in safety production. 5. Receiving donation by taking advantage of his/her post. 6. Drinking before going to work or drinking in the plant. 7. Disobey the department arrangement on overtime work without a good reason. 9 Article 49: In any one of the following cases, the employee shall be punished in the form of pulsory resignation or disciplinary dismissal. 1. 2 breaches of the cases in Article 48(second grade punishment) within 3 months。 2. Gambling or playing cards in the pany。 Sleeping or watching television during working hours. 3. Refusing the order of transfer, personal work stoppage without proper reason, systematically pushing down the efficiency intentionally. 4. Fraud or attempt at fraud or stealing, in order to embezzle the pany’s and individual’s money and property. 5. Disclosure of the pany’s “Trade Secret” or personal disposal of pany’s “Intellectual Rights”. 6. Creation of agitation in the pany, uses or attempt to use violence and disturbance to the discipline of the pany. Or turning a blind eye to the above action with no attempt to stop or report it. 7. Negligence of duty and careless of safety regulations which leads to serious accident and big loss in the pany. 8. Accumulated absent working day exceeds 30 days or 3 consecutive absent working days without going through the stipulated procedures. Article 50: Disciplinary punishment shall be carried out by personnel department according to the relevant procedure. Prior to the formal announ of punishment decision, the discipline breaching ratification form and other materials shall be sent to relevant department supervisor, General Manager, and to the employee concerned in written notice. In the case that the employee concerned doesn’t agree with the punishment, he/she shall put forward written appeal to personnel manager/General manager of the pany within 3 days. Article 51: After receiving the written appeal of employee, the pany shall recheck the case to see if the punishment is appropriate. If the employee doesn’t put forward the written appeal within 3 day, the punishment decision shall be effective. Article 52: Fines shall be deducted from the employee’s salary. Chapter 9 Supplementary Provisions Article 53: The right of explanation to this handbook belongs to the General Manager and all pany management mittee members. Any modification to this handbook shall be ratified by the pany management mittee. 10 Article 54: Any labor dispute arising between the pany and its employees form the enfor of this handbook shall be handled according to the present legal procedures. Article 55: This Employee Handbook was passed on board meeting on _______________. The handbook shall e into effect upon signature by the General Manager and shall be submitted to the XXX Labor Bureau for file.
