【導(dǎo)讀】夫妻約定財(cái)產(chǎn)制不僅能夠妥善處理夫妻之間的財(cái)產(chǎn)歸屬及對(duì)財(cái)產(chǎn)行使相關(guān)權(quán)利的資格，而且能夠減少婚姻關(guān)系終。止時(shí)由于財(cái)產(chǎn)引起的糾紛，減輕當(dāng)事人的舉證責(zé)任，保證訴訟的高效率，維護(hù)相關(guān)權(quán)利人的合法權(quán)益。改一定程度上完善了夫妻約定財(cái)產(chǎn)制度，因?yàn)槲覈?guó)的文化觀念以及經(jīng)濟(jì)基礎(chǔ)等先天性條件的制約下，夫妻約定財(cái)產(chǎn)制度。本文主要是介紹夫妻約定財(cái)產(chǎn)制度，指出該制度主要的缺陷以及對(duì)相應(yīng)問題提出幾點(diǎn)立法建。夫妻約定財(cái)產(chǎn)制被大多數(shù)國(guó)家的法律所肯。定或者夫妻之間的約定沒有法律效力的情形下才適用法定夫妻財(cái)產(chǎn)制。后者則相反，立法對(duì)于夫妻雙方的約定限制較多，對(duì)于約。是符合物權(quán)公示原則，有利于保護(hù)第三者的合法權(quán)益。一般共同制是指當(dāng)事人雙方將其在婚前和婚后所得的全部財(cái)產(chǎn)所有權(quán)。在英國(guó)，夫妻間的財(cái)產(chǎn)協(xié)議被稱為是有錢人的結(jié)婚必需品，英國(guó)。下達(dá)成財(cái)產(chǎn)協(xié)議，則另一方有權(quán)請(qǐng)求確認(rèn)協(xié)議無效或撤銷協(xié)議。在婚姻生活中，夫妻一方不可避免的與第三人發(fā)生財(cái)產(chǎn)關(guān)系，
【正文】 習(xí)慣的要求，擬結(jié)為夫妻的雙方當(dāng)事人能夠明確的法律資格進(jìn)行約定財(cái)產(chǎn)關(guān)系對(duì)于司法實(shí)踐具有重要意義。 五、結(jié)語 我國(guó)的夫妻約定財(cái)產(chǎn)制，有著客觀因素決定的缺陷，立法者應(yīng)該根據(jù)實(shí)際情況不斷完善我國(guó)的夫妻財(cái)產(chǎn)約定制度，使之不斷適應(yīng)夫妻財(cái)產(chǎn)關(guān)系的新發(fā)展，滿足司法實(shí)踐的要求以及更好維護(hù)當(dāng)事人的利益。本文從我國(guó)現(xiàn)如今的夫妻約定財(cái)產(chǎn)制的不足之處出發(fā)，找出其相應(yīng)的解決辦法。筆者對(duì)我國(guó)夫妻約定財(cái)產(chǎn)制的法律依據(jù)分散、法條含混、夫 妻財(cái)產(chǎn)協(xié)議公示以及變更撤銷程序規(guī)定不明確等問題提出一些意見，希望立法者能夠重視這個(gè)制度的相關(guān)立法，希望法律學(xué)者們能夠?qū)@個(gè)制度有更加深入的研究，是我國(guó)的夫妻約定財(cái)產(chǎn)制度不得發(fā)展完善，更好的適用于夫妻之間，使婚姻家庭生活走上和諧的軌道。 參考文獻(xiàn) [1]蔣月 主編 .婚姻家庭與繼承法 [M].廈門大學(xué)出版社 .2021年 8月第二版 .第 146147頁(yè) .
