【正文】 有犯錯(cuò)誤的時(shí)候。而不同的人有不同的道德認(rèn)知能力和道德意志能力，在許多情境下對問題的認(rèn)識有差異，不能用正確的道德理性調(diào)控自己判斷和選擇，往往會對現(xiàn)實(shí)中的邪惡妥協(xié)，而發(fā)生公共管理者本位職責(zé)與社會職責(zé)之間的沖突。因?yàn)?，公共管理者的利益和社會民眾的利益在根本上是一致的。作為公共管理者的社會職?zé) 是指公共管理者作為一般社會成員所應(yīng)當(dāng)承負(fù)的社會責(zé)任與義務(wù)。第三，公共管理者本位職責(zé)與社會職責(zé)的沖突引發(fā)的道德風(fēng)險(xiǎn)。此時(shí)，作為公共管理者個(gè)人必須要對自己的職責(zé)義務(wù)有一個(gè)清醒的認(rèn)識和把握，必須有足夠的道德勇氣區(qū)分開個(gè)人領(lǐng)域和公共領(lǐng)域中的職責(zé)義務(wù)。這種沖突和碰撞，究其實(shí)質(zhì)就是為自己的利益還是為他人的利益來履行角色職責(zé)。然而 ,作為公共管理的主體，公共管理者更有責(zé)任與義務(wù)為公共利益服務(wù)，很顯然，一個(gè)公共管理者作為公共管理的主體與作為普通社會成員，這兩種角色如何和諧共處是個(gè)很難兩全的問題。在現(xiàn)代民主社會中 ,每一個(gè)人都擁有平等的基本自由權(quán)利。作為公共管理者的個(gè)人義務(wù)是指他們在個(gè)人領(lǐng)域里維護(hù)自己正當(dāng)權(quán)益的職責(zé)和義務(wù)，公共義務(wù)是指公共管理者在公共領(lǐng)域里為維護(hù)公共利益所應(yīng) 盡的職責(zé)和義務(wù)。如果他們不能正確對待自己所執(zhí)掌的權(quán)力，把個(gè)人領(lǐng)域和公共領(lǐng)域混為一談，用可以支配他人以及公共資源的公共權(quán)力牟取私人利益而非公共利益，就會導(dǎo)致道德風(fēng)險(xiǎn)的存在。在公共領(lǐng)域中，公共利益是第一位的，如果公共權(quán)力被用來優(yōu)先維護(hù) 公共管理者個(gè)人權(quán)利的話，那么公共權(quán)力就會變質(zhì)，發(fā)生異化。而在私人領(lǐng)域中，個(gè)人利益追求的是一種現(xiàn)實(shí)的活動(dòng)，個(gè)人可以提出自己的權(quán)利要求，可以通過正當(dāng)途徑維護(hù)自己的權(quán)利，但個(gè)人沒有理由運(yùn)用公共權(quán)力來擴(kuò)展自己的權(quán)利。如果一個(gè)人不能夠建立和擁有這種信仰，他就不應(yīng)當(dāng)進(jìn)入公共管理者隊(duì)伍中來。公共管理者成為 “公共人 ”正是現(xiàn)代社會的要求，也是公共管理者應(yīng)當(dāng)具有的特性。 “公共性是政府的第一屬性 ”① ，公共管理者的道德價(jià)值取向是以公共利益為依歸的 ,這種意義上的公共管理者就成了 “公共 ”人。第一，公共管理者個(gè)人利益與公共利益的沖突引發(fā)的道德風(fēng)險(xiǎn)。 5 r ules and r egulat ions, t he pany r esponsible f or t he developm ent , examinat ion, inspect ion and t r aining, Discover y M anager . 10 qualit y accident s of wor k, t he pany r esponsible f or t he Depart ment of invest igation, j udge, pr ocessing, analysis, summar y and r epor ting。 4, is r esponsible f or t he pany39。 3, r esponsible f or t he pany39。 二、 三、 二、公共管理者的身份沖突與公共管理中的道德風(fēng)險(xiǎn)現(xiàn)實(shí)的人在社會生活中往往會扮演多種角色身份，公共管理者也不例外，他們既是 “個(gè)體 ”的人又是 “公共 ”的人，這樣在他們的道德選擇中會經(jīng)常性的面對 “個(gè)人利益和公共利益的沖突 ”“個(gè)人義務(wù)與公共管理者義務(wù)的沖突 ”“本位職 責(zé)與社會職責(zé)的沖突 ”，這種由于身份不同而形成的沖突如果處理不好就會引發(fā) plet e t em por ar y t asks assigned by t he M anager.
