CREAT THIS MANUAL ENBODYING STANDARDS OF INTERNATIONAL MARITIME LABOUR CONVENTIONS, NATIONAL LAWS, REGULATIONS AND RELATIVE AGREEMENTS TO ENSURE ONGOING COMPLIANCE BETWEEN INSPECTIONS.為有效地實行和執(zhí)行2006年海事勞工公約(以下簡稱“公約”),確保海員體面的就業(yè),臺州市椒江楓葉海運有限公司制定本手冊,本手冊參照國際海事勞工公約,國家法律,條例及相關(guān)的協(xié)議的要求,以確保檢查之間持續(xù)符合公約的要求I SOLEMNLY PROMISE:我在此鄭重承諾:THE COMPANY RESPECT THAT SEAFARER HAVE THE FUNDAMENTAL RIGHTS AND PRINCIPLES APPLICABLE TO ALL PERSONS AND SEAFARES’S EMPLOYMENT AND SOCIAL RIGHT, 公司尊重海員所享有的適用于所有人的基本權(quán)利和自由以及海員的就業(yè)和社會權(quán)利, UNDERTAKE THAT EACH SEAFARE EMPLOYED HAS THE RIGHT: 承諾雇傭的每名海員充分享有以下權(quán)利:1. TO A SAFE AND SECURE WORKPLACE THAT COMPLIES WITH SAFETY STANDARDS;享有符合安全標(biāo)準(zhǔn)的安全且受保護(hù)的工作場所;2. TO FAIR TERMS OF EMPLOYMENT;獲得公平的就業(yè)條件;3. TO DECENT WORKING AND LIVING CONDITIONS ON BOARD SHIP.獲得體面的船上工作和生活條件;4. TO HEALTH PROTECTION, MEDICAL CARE, WELFARE MEASURES AND OTHER FORMS OF SOCIAL PROTECTION。FULLY AUTHORIZED THE DESIGNATED PERSON TO EFFECTIVELY EXERCISE CONTROL ON THE SEAFARER AND MANAGED VESSEL, INCLUDING REGULAR INSPECTION, REPORTING, MONITORING AND PROCEEDING THROUGH THE PROCEDURE HAS BEEN DRAW UP, PROHIBITING AND CORRECTING THE VIOLATIONS OF THE REQUIREMENTS OF MLC 2006,IN ORDER TO PROPERLY COMPLING WITH AND ENFORCING THE RIGHT AND PRINCIPLES,授權(quán)指定人員對管理的海員和船舶有效地進(jìn)行管理,包括按照本程序進(jìn)行的定期檢查,報告,以確保這些權(quán)利和原則妥善的遵守和執(zhí)行?!爸鞴墚?dāng)局”一詞系指有權(quán)就公約規(guī)定的事項頒布和實施具有法律效力的條例、命令或其他指令的部長、政府部門或其他當(dāng)局;b) Declaration Of Maritime Labour Compliance means integrated documents for the implementation of requirements of the Convention and regulations of the flag state on board ship。“海事勞工證書”一詞系指海事勞工證書:指船旗國主管當(dāng)局或授權(quán)的認(rèn)可組織經(jīng)對船舶實施海事勞工條件檢查后簽發(fā)的證書,證書有效期不得超過5 年。 e) Seafarer means any person who is employed or engaged or works in any capacity on board a ship under Company management“海員”一詞系指本公司管理船舶上以任何職務(wù)受雇或從業(yè)或工作的任何人員;f) Seafarers’Employment Agreement includes both a contract of employment and articles of agreement signed by Seafarer and the Company?!昂T招募和安置服務(wù)機構(gòu)”一詞系指公共或私營部門中從事代表公司招募海員或與船東安排海員上船的任何個人、公司、團(tuán)體、部門或其他機構(gòu);i) Maritime Labor Condition means that seafarer has a right to fair terms of employment, to decent working and living conditions on board ship and to health protection, medical care, welfare measures and other forms of social protection.“海事勞工條件” 系指公約要求的海員有權(quán)獲得的公平就業(yè)條件;體面的船上工作和生活條件;符合安全標(biāo)準(zhǔn)的工作場所和健康保護(hù)、醫(yī)療、福利、社會保障等諸方面的條件。k) Shipowner means Maple Leaf Shipping Co.,Ltd, who has assumed the responsibility for the operation of the ship from the owner and who, on assuming such responsibility, has agreed to take over the duties and responsibilities imposed on shipowners in accordance with this Convention, “船東”一詞系指臺州市椒江楓葉海運有限公司(以下簡稱“公司”),其承擔(dān)了船舶經(jīng)營責(zé)任并在承擔(dān)這種責(zé)任時已同意接受船東根據(jù)本公約所承擔(dān)的職責(zé)和責(zé)任2.
