業(yè)務(wù)或收集業(yè)務(wù)信息期間發(fā)生其個人與本公司利益上的沖突。b. The EMPLOYEE has asked for or received any advantage or benefits either in monetary or non monetary term of any kind form persons or organisations having business activities directly or indirectly with the COMPANY.該員工向與本公司有直接或間接業(yè)務(wù)往來的任何個人或機構(gòu)索取或收受任何貨幣或非貨幣形式的財物或好處。c. The EMPLOYEE fails to perform his/her responsibilities under Articles 14 and Article 15 of this CONTRACT.該員工違反本合同第14條和第15條的規(guī)定。d. The EMPLOYEE left from his/her work for more than five (5) working days without prior consent from the Chief Executive Officer except in the case of force majeure which prevent the EMPLOYEE from informing the Chief Executive Officer.該員工事先未經(jīng)首席執(zhí)行官準(zhǔn)許擅自離崗超過五個工作日,若因不可抗力導(dǎo)致該員工無法通知首席執(zhí)行官除外。 The EMPLOYEE may also hand over a written notice of his/her resignation for personal reasons 30 days ahead. If the EMPLOYEE does not provide the COMPANY with one month’s notice, he/she should pay to the COMPANY one calendar month of salary and allowance mentioned in Article 4 as the pensation.若由于其個人原因,該員工可提前三十天以書面形式提出辭職。若該員工沒有提前三十天向公司遞交辭呈,該員工將向公司支付依本合同第4條所規(guī)定的一個月的月工資及補助作為補償金。 The COMPANY shall pay to the EMPLOYEE any pensation pursuant to relevant laws and regulations of the People’s Republic of China in case of termination of this CONTRACT unless otherwise provided by the laws or resulting from the occurrence of the termination events agreed by PARTIES hereof or resignation of the EMPLOYEE for personal reasons. The maximum amount of pensation by the COMPANY will not exceed one calendar month of salary and allowance mentioned in Article 4若本合同解除,本公司將遵照中華人民共和國有關(guān)法律法規(guī)向該員工支付補償金,該補償金總數(shù)不超過本合同第4條所規(guī)定的一個月的月工資與補助總額。合同雙方依法另行約定解除本合同或者該員工出于個人原因提出辭職的除外。 In case of termination of this CONTRACT due to fault of the EMPLOYEE or resignation of the EMPLOYEE for personal reasons:若因該員工的過失或該員工出于個人原因解除本合同,則:a. COMPANY need not pay to the EMPLOYEE the yearly bonus provided in Article 5 hereto。 and本公司無須向該員工支付本合同第5條規(guī)定的年終獎金。b. The EMPLOYEE shall refund to the COMPANY all the expenses and costs for the training provided to the EMPLOYEE according to Article 7 hereto.該員工應(yīng)按照本合同第7條的規(guī)定退還本公司為其提供培訓(xùn)投入的所有費用。ARTICLE 18: AMENDMENT OF THE CONTRACT第十八章:合同修訂 This CONTRACT may be revised upon agreement of both PARTIES. Any amendment to this CONTRACT shall e into force only after a written agreement has been signed by both PARTIES.本合同經(jīng)合同雙方同意可作修訂。本合同任何修訂內(nèi)容須經(jīng)合同雙方簽署書面協(xié)議后方能生效。ARTICLE 19: APPLICABLE LAW第十九條:適用法律 The formation, validity, and performance of this CONTRACT and disputes thereon shall be governed by the laws of the People39。s Republic of China.本合同的格式、有效期、履行、以及對本合同的爭議應(yīng)遵照中華人民共和國法律法規(guī)執(zhí)行。ARTICLE 20: SETTLEMENT OF DISPUTES第二十條:爭議的處理及解決 Any disputes arising from the performance of or in connection with this CONTRACT shall be settled through friendly consultations between the PARTIES.任何因履行本合同或由本合同相關(guān)事宜引發(fā)的爭議,應(yīng)由合同雙方友好協(xié)商解決。 In case no settlement can be reached through consultations the PARTIES can apply for mediation to the labour dispute conciliation mittee established by the COMPANY, if any.若無法協(xié)商解決,合同雙方可根據(jù)需要向本公司組建的勞動爭議管理委員會申請調(diào)解。 If mediation can not be reached the PARTIES may apply to arbitration to the relevant labour dispute arbitration mittee.若無法實現(xiàn)調(diào)解,合同雙方可向相關(guān)勞動爭議仲裁委員會申請仲裁。If a PARTY disagrees with the arbitrage award rendered by such mittee this PARTY may file a suit in the Baohe District People’s Court within fifteen (15) days of being notified the said arbitrage award.若合同任何一方對上述勞動爭議仲裁委員會給予的仲裁結(jié)果持有異議,該合同方可于接到仲裁結(jié)果后十五日內(nèi)向合肥市包河區(qū)人民法院提起訴訟。ARTICLE 21: MISCELLANEOUS第二十一條:其它事宜 This CONTRACT shall be written in Chinese and English versions.
