【正文】 重復(fù)。王學(xué)斌. 環(huán)境侵權(quán)責(zé)任中因果關(guān)系的認(rèn)定［Ｄ］.結(jié)語在環(huán)境侵權(quán)因果關(guān)系的認(rèn)定方法上，通過我國司法實(shí)踐一些情況可知，舉證責(zé)任倒置說和因果關(guān)系推定說都有采納，但是立法上既有舉證責(zé)任倒置原則，也有規(guī)定因果關(guān)系推定理論，立法上的不統(tǒng)一、不明確，直接導(dǎo)致了法院在審理環(huán)境侵權(quán)案件時(shí)出現(xiàn)同案不同判的情況。本文通過仔細(xì)考察分析，認(rèn)為因果關(guān)系推定說相比舉證責(zé)任倒置說，更符合法律對(duì)公平正義的追求，也更符合我國的國情。我國在具體運(yùn)用因果關(guān)系推定說時(shí)可以在立足國情的基礎(chǔ)上，借鑒發(fā)達(dá)發(fā)達(dá)國家先進(jìn)的立法經(jīng)驗(yàn)和技術(shù)，并結(jié)合我國國情，推行出符合我國發(fā)展的因果關(guān)系施行制度。參考文獻(xiàn)[1]［Ｄ］.[2]［Ｄ］.[3]［Ｄ］.[4]［Ｄ］.[5]［Ｄ］.[6]王學(xué)斌. 環(huán)境侵權(quán)責(zé)任中因果關(guān)系的認(rèn)定［Ｄ］.[7]［Ｄ］.[8]［Ｍ］.北京:[9]［Ｍ］.北京:[10]［Ｍ］.北京:[11]奚曉明，王利明主編:《侵權(quán)責(zé)任法條文釋義》［Ｍ］.[12]張新寶:《中國侵權(quán)行為法》［Ｍ］.[13]張新寶:《侵權(quán)責(zé)任法立法研究》，中國人民大學(xué)出版社2009年版 On the Determination of Causation of Environmental TortLai Weixian【Abstract】 Since the eighties of last century, China39。s three major industries have made a historic leap, but in the environmental ecology has paid a heavy price, environmental infringement disputes more and more acute.
