濃重一些。當(dāng)然,本文并沒(méi)有涵蓋產(chǎn)品質(zhì)量法當(dāng)中的所有的具有競(jìng)爭(zhēng)法色彩的條文,如關(guān)于禁止偽造或冒用認(rèn)證標(biāo)志、名優(yōu)標(biāo)志等質(zhì)量標(biāo)志。禁止偽造產(chǎn)地或冒用他人廠名、廠址的規(guī)定,以及對(duì)禁止虛假宣傳,欺騙和誤導(dǎo)消費(fèi)者的規(guī)定。這些不正當(dāng)競(jìng)爭(zhēng)行為已有較為完備的論述,另外,就產(chǎn)品推薦和產(chǎn)品認(rèn)證中的反限制競(jìng)爭(zhēng)問(wèn)題還需另外撰文仔細(xì)分析,本文不再熬述。由上分析可以看出,準(zhǔn)確理解適用《產(chǎn)品質(zhì)量法》的規(guī)定,對(duì)建立和維護(hù)公平競(jìng)爭(zhēng)秩序,增加社會(huì)經(jīng)濟(jì)的整體效率,增進(jìn)社會(huì)整體福利,都有其意義?! he function of the article 11 of the quality of product law to restrict the district monopoly Sun Pengcheng (East China University of Politics and Law, shanghai 200042 China) 【Abstract】Distinct monopoly is regulated by the article 11 of the quality of product law in new revision.
