【文章內(nèi)容簡介】 培訓(xùn)包括海外培訓(xùn)〕乙方必須遵守甲方的培訓(xùn)條規(guī)和承諾。Party B shall observe Party A’s training rules and undertaking when Party A assigns Party B to be trained.八、 甲方無償解除合同Article Eight Cancellation of the Contract without pensation by Party A假設(shè)符合以下情況之一的甲方可以隨時(shí)解除合同而不必給予乙方任何經(jīng)濟(jì)補(bǔ)償：Party A may cancel the Contract at any time without pensation to Party B under the following circumstances: 當(dāng)乙方在試用內(nèi)不符合甲方的職工錄用條件甲方無須給予乙方解除的原因。 When Party B is proven to be unqualified for Party A’s employment conditions during probation period, Party A need not give Party B the reason for cancellation. 乙方嚴(yán)重違犯甲方依法制定的規(guī)章制度和勞動紀(jì)律。 Party B seriously violates rules and regulations, labor discipline legally stipulated by Party A. 乙方嚴(yán)重瀆職營私舞弊給甲方利益造成重大損失。 Party B seriously neglects his/her duty and grafts resulting in Party A’s great loss. 乙方違犯中國法律受到處分或追究刑事責(zé)任。Party B violates the laws of PRC and gains judicial punishment or is found a guilty. 九、 甲方有償解除合同Article Night Cancellation of the Contract with pensation by Party A有以下情形之一的甲方可以解除勞動合同但是應(yīng)當(dāng)提早30天以書面形式乙方或支付一個(gè)月根本工資代替并依法支付乙方經(jīng)濟(jì)補(bǔ)償金或補(bǔ)助費(fèi)。Under the following circumstances, Party A may cancel the Contract with 30 days prior written notice to Party B or paying one month basic wage instead and legally pay economic pensation or subsidy to Party B. 乙方患病或非因工受傷醫(yī)療滿后仍不能從事原工作或由甲方另行安排的工作的。 Party B is ill or nonworkrelated injured, and unable to do the former job or other job assigned by Party A after medical treatment. 乙方不能勝任工作經(jīng)過培訓(xùn)或調(diào)整工作崗位仍不能勝任的。 Party B is not petent for the job and still remains so after training or adjustment of the post. 本合同訂立時(shí)所根據(jù)的客觀情況發(fā)生重大變化致使本合同無法履行甲乙雙方不能就變更本合同達(dá)成協(xié)議的。The basis for the conclusion of the contract has greatly anged so that the contract can no longer be carried out, while both parties can not rea an agreement on modifying the contract by mutual negotiation. 甲方瀕臨破產(chǎn)進(jìn)入法定整頓間或者消費(fèi)經(jīng)營狀況發(fā)生嚴(yán)重困難到達(dá)當(dāng)?shù)厝嗣褚?guī)定的嚴(yán)重困難企 業(yè)確須裁減人員并按法定程序解除勞動合同的。Party A is close to bankrtcy and enters into legal rectification period or it is in a severe difficulty to meet the standard of severe difficult enterprise stipulated by the local government and the retrenment is needed, and then Party A cancels the contract according to legal procedure.十、 乙方要求解除合同Article Ten Cancellation of the Contract at Party B’s request 。 Party B shall give 30days prior written notice to Party A when requ
