The defences and limits of liability provided for in these Rules shall apply in any action against the carrier in respect of loss or damage to goods covered by a contract of carriage whether the action be founded in contract or in tort. 2. If such an action is brought against a servant or agent of the carrier (such servant or agent not being an independent contractor), such servant or agent shall be entitled to avail himself of the defences and limits of liability which the carrier is entitled to invoke under these Rules. ? （ 2）無過失免責(zé)： ? 非承運(yùn)人過失的火災(zāi)、不可抗力的自然力量、不可抗力的人為力量、托運(yùn)人的原因（潛在缺陷、包裝、標(biāo)志等的原因） ? 非承運(yùn)人及其代理人的原因、其他原因 托運(yùn)人的責(zé)任 （ 1）保證義務(wù)； （ 2）提交單證； （ 3）通知義務(wù)； （ 4）支付運(yùn)費(fèi)。 （四）關(guān)于提單運(yùn)輸?shù)娜齻€(gè)國際公約 《海牙規(guī)則》（ Hague Rules） 《 1924年統(tǒng)一提單的若干法律規(guī)則的國際公約》 ( International Convention for the Unification of Certain Rules of Law Relating to Bill of Lading ) 特點(diǎn)：代表主要航運(yùn)大國的利益，側(cè)重對船東利益的保護(hù) 《維斯比規(guī)則》（ Visby Rules） 《修改統(tǒng)一提單的若干法律規(guī)則的國際公約的議定書》 (Protocol to Amend the International Convention for the Unification of Certain Rules of Law relating to Bills of Lading) 簡稱《海牙－維斯比規(guī)則》 (HagueVisby Rules) ? 特點(diǎn)： ? （ 1）提高了承運(yùn)人的賠償限額，規(guī)定了雙重限額： ? 每件或每一單位 10， 000個(gè)金法郎( SDR)或毛重每公斤 30個(gè)金法郎(2個(gè) SDR)； ? （ 2）索賠與訴訟時(shí)效：除 1年時(shí)效外，期滿后承運(yùn)人仍可有 3個(gè)月向第三者追償 ? （ 3）增加了有關(guān)集裝箱的規(guī)定 《漢堡規(guī)則》（ Hamburg Rules） 《聯(lián)合國海上貨物運(yùn)輸公約》 （ United Nations Convention on the Carriage of Goods by Sea） 特點(diǎn)：船方和貨方合理分擔(dān)風(fēng)險(xiǎn)的原則，適當(dāng)加重了承運(yùn)人的責(zé)任，使雙方權(quán)利義務(wù)趨于平等。 （
