The Buyer may put forward the opinion if necessary, and Seller shall ply with such opinion. . 若 工裝模具 出現(xiàn)重大故障，賣(mài)方須立即以書(shū)面形式通知買(mǎi)方。如果屬于產(chǎn)品質(zhì)量問(wèn)題，賣(mài)方應(yīng) 根據(jù)買(mǎi)方的指示 立即聯(lián)系 工裝模具 供應(yīng)商進(jìn)行修復(fù)，并為買(mǎi)方之利益追究 工裝模具 供應(yīng)商的責(zé)任；如果因賣(mài)方的過(guò)錯(cuò)造成 工裝模具 故障的，賣(mài)方除應(yīng)當(dāng)自費(fèi)修復(fù)或更新 工裝模具 外，還應(yīng)當(dāng)承擔(dān)因無(wú)法正常生產(chǎn) 所導(dǎo)致的買(mǎi)方的一切損失。 In the event of any substantial malfunction of the Vender Tooling(s), the Seller shall notify the Buyer in written immediately. If such malfunction is arising from the product quality, the Seller shall municate with the supplier of the Vendor Tooling(s) and require the supplier to repair the Vendor Tooling(s) in accordance with the direction of the Buyer. In addition, the Seller shall claims against the supplier of the Vendor Tooling(s) for the sake of the Buyer。 If such malfunction is arising from the fault of the Seller, the Seller shall not only repair or update the Vendor Tooling(s) at its own cost but also indemnify all losses resulting from the production interruption. 5. 賠償 Remedies . 在 本 協(xié)議履行期間，出現(xiàn)不可抗力而導(dǎo)致賣(mài)方不能履行或不能完全履行 本 協(xié)議，賣(mài)方不承擔(dān)由此產(chǎn)生的法律責(zé)任。 If the Seller fails to perform or pletely perform its obligations under this Agreement due to Force Majeure, the Seller shall not bear the responsibility arising from such event. 4 . 工裝模具若因賣(mài)方使用或保管不當(dāng)遭致?lián)p壞、毀壞、破壞或滅失，賣(mài)方應(yīng)就此種損壞、毀壞、破壞或滅失承擔(dān)損害賠償責(zé)任。賣(mài)方未遵守本協(xié)議項(xiàng)下的規(guī)定，則應(yīng)當(dāng)賠償買(mǎi)方由此所遭受的一切損失。 In the event of any broken, destroy, diminishment, or losses arising from the improper using or keepin
