【正文】 strue　　釋義：construe是法律英語中的重要單詞，意思是解釋，即對法律、合同等法律文件的內(nèi)容作出解釋，與interpret意思相同。如Each party agrees to protect the other’s Confidential Information at all times and in the same manner as each protects the confidentiality of its own proprietary and confidential materials．各方同意，在任何時候都以保護(hù)自身專有資料和機密資料相同的方式保護(hù)另一方的機密信息?！　　　omposition　　釋義：position在普通英語中的常見意思為作文，結(jié)構(gòu)，在法律英語中的意思為和解協(xié)議，指指債務(wù)人與全部或至少相當(dāng)一部分債權(quán)人達(dá)成的此類協(xié)議。如claim damages要求損害賠償金，claim on the insurance 進(jìn)行保險索賠，reject a claim拒絕一項索賠請求等?！　　　ircumstance　　釋義：circumstance在普通英語中指環(huán)境，情景。如If Party A materially breaches this Contract，Party B or its successor in interest is entitled to terminate this Contract or claim damages for the breach of contract．如果甲方實質(zhì)性違反本合同，乙方或其權(quán)益承繼人有權(quán)終止本合同或要求得到損害賠償。如the agreement binds all the parties to it協(xié)議對各方均有約束力，bind sb. to do使某人負(fù)有做…事情的義務(wù)等。　　　　bankrupt　　釋義：bankrupt的意思是破產(chǎn)，既可以指單位也可以指個人破產(chǎn)。又如Without the prior, express written consent of the Principal, the Agent may not assign this Agreement to any other ，代理方不得將本協(xié)議轉(zhuǎn)讓給任何第三方。如fixed asset固定資產(chǎn)，floating asset流動資產(chǎn)，Asset and capital verification 清產(chǎn)核資，asset management資產(chǎn)管理等。本法自2009年1月10生效。如deliver the house as 。如“Affiliate” means any person or pany that directly or indirectly controls a Party or is directly or indirectly controlled by a Party，including a Party’s parent or subsidiary, or is under direct or indirect mon control with such Party.“關(guān)聯(lián)公司”指直接或間接控制一方(包括其母公司或子公司)或受一方直接或間接控制，或與該方共同受直接或間接控制的任何人或公司?！　　　ffect　　釋義：affect是普通英語中最常見最普通的單詞之一，意思是影響，通常用在口語和非正式的場合中?！　　　dopt　　釋義：adopt的最常見含義是采用，通過，如adopt a law通過一項法律，adopt a proposal采納一個建議等，這種用法在法律英語中也較為常見。A，即是acquire的名詞acquisition和merger的縮寫。　　　　　　　　　　　　　　　　　　Accord　　釋義：accord在普通英語中的含義是符合，一致，在法律英語中則表示和解或和解協(xié)議，指指債務(wù)人和一個債權(quán)人達(dá)成的、以償還部分債務(wù)免除全部債務(wù)責(zé)任的協(xié)議。第二個標(biāo)準(zhǔn)時單詞意義或用法的特殊性，如accept在普通英語中是接受，在法律英語中卻表示承諾或?qū)ζ睋?jù)的承兌等，另外，如我們平時最常用的單詞affect，在普通英語中的用法非常普遍，而且相對influence 和impact等單詞，是較多用語口語中的單詞，但在法律英語中，表示權(quán)利義務(wù)或利益受到影響時，用的都是affect，而不是influence。法律英語的單詞有其特殊用法和含義，怎樣從眾多的法律英語詞匯中挑選出最常用最實用的單詞一直是困惑眾多法律英語愛好者的問題。其實，雖然法律英語單詞眾多，但我們在法律實務(wù)中接觸到的常用法律英語詞匯大概只有2000個左右，boblegal法律翻譯對這些常用單詞（主要是民事和經(jīng)濟(jì)方面）進(jìn)行了篩選，以實務(wù)為導(dǎo)向，進(jìn)行法律英語典型單詞系列講解?！　⌒枰f明的兩點是，有些單詞在法律英語中有獨特含義，如service，在法律英語中的特殊含義指法律文書的送達(dá)，但其普通含義即服務(wù)，也可能被用到，如service agreement服務(wù)協(xié)議等，因此，我們不能機械的認(rèn)為service無論出現(xiàn)在何種法律文書中均指送達(dá)，應(yīng)當(dāng)結(jié)合上下文進(jìn)行理解。如reach an accord達(dá)成和解協(xié)議，accord and satisfaction和解與清償?shù)取Ｈ鏣he foreign investor has acquired more than 10 PRC domestic enterprises engaging in related industries within a year. 外國投資者一年內(nèi)并購中國境內(nèi)關(guān)聯(lián)行業(yè)的企業(yè)超過10個。另外，adopt在法律英語中可能會用到一個含義是收養(yǎng)，如adopt an orphan according to law根據(jù)法律規(guī)定收養(yǎng)孤兒。但在法律英語，affect（本義沒有改變，仍然是影響），確實非常正式的用法，通常不能用influence等單詞替換?！　　　gent　　釋義：agent也是法律英語中常見單詞之一，意思是代理人，代理商，通常指商業(yè)代理，如果指非商業(yè)性質(zhì)的代理，如替別人出席會議等，則可用proxy。The software is provided as 。The contract takes effect upon its execution?！　　　ssign　　釋義：assign是法律英語中常用單詞之一，意思是轉(zhuǎn)讓，也可以指受讓人,通常指權(quán)利的轉(zhuǎn)讓?！　　　ttach　　釋義：attach在普通英語中的含義是依附，粘貼，在法律英語中指扣押財產(chǎn)。如go bankrupt破產(chǎn)，declare bankrupt宣布破產(chǎn)，adjudicate sb.
