【正文】 Recruitment and placement 公司依據(jù) MLC公約和船旗國相關(guān)法律涉及招募和安置的規(guī)定,制定了海員的招募與安置管理程序 ,免費(fèi)為海員提供了的高效 、 充分和可靠的船上就業(yè)的機(jī)會(huì) 。 The recruitment and placement department carries out the seafarers recruitment and placement according to the procedure and flow of work, thinks about the requirements and guidelines of state laws and regulations and international conventions concerned. 公司所聘用的海員均通過直接招募的方式獲得,在其受聘前和過程中被告知就業(yè)協(xié)議上的權(quán)利和職責(zé),以及適用的集體協(xié)議中的相關(guān)要求。According to laws of flag state , consulting the Chinese Seafarers collective agreement ( Category A ) which signed by both the Chinese Seafarers Development Union and the China Shipowner Association , made out our Seafarers collective agreement and Seafarers employment contract. 《 船 員就業(yè)協(xié)議》的基本內(nèi)容應(yīng)包括: Seafarers employment contract shall in all cases contain the following particulars: 1) 海員的全名、出生日期或年齡、出生地; the seafarer’s full name, date of birth or age, and birthplace。 3) 簽訂就業(yè)協(xié)議的地點(diǎn)和日期; the place where and date when the seafarers’ employment agreement is entered into。 5) 海員的工資待遇; the amount of the seafarer’s wages 。 7) 協(xié)議的終止及其終止條件 the termination of the agreement and the conditions thereof。 9) 海員獲得遣返的權(quán)利; the seafarer’s entitlement to repatriation。 any other particulars which national law may require. 《 船 員就業(yè)協(xié)議》的簽訂 signing the Seafarers employment contract 海員上船工作前,須與公司簽訂《 船 員就業(yè)協(xié)議》。 It should be made sure that the rights and responsibilities of Company and seafarers respective, the hours of work, pay and treatment in the Seafarers’ employment contract. 公司與每位海員在簽 訂 《 船 員就業(yè)協(xié)議 》 時(shí) , 應(yīng)給予時(shí)間讓海員有機(jī)會(huì) 對(duì) 《 船 員就業(yè)協(xié)議》進(jìn)行審查和征詢意見,在充分理解了其權(quán)利和義務(wù)及自愿情況下簽署。 Company and seafarer concerned shall each have a signed original of the seafarers’ employment agreement. 船上保留一份《 海員就業(yè)協(xié)議 》副本和 本公司的《 船員集體協(xié)議》, 以利于包括船長(zhǎng)在內(nèi)的海員在船上可以容易地獲得關(guān)于其就業(yè)條件的明確信息,并能夠供主管當(dāng)局 的官員,包括船舶所掛靠港口的官員查驗(yàn)。 Minimum notice period to be given by the seafarers and Company for the early termination of a seafarers’ employment agreement should meet the requirement of flag state, but shall not be shorter than seven days. 作為特殊情況,在不違背國家法律或條例 和公司 的《船員集體協(xié)議》前 提下,公司保證考慮海員出于值得同情的原因或其他緊急原因提前較短時(shí)間通知或不通知就終止就業(yè)協(xié)議的需要。 Seafarer have a Seafarer service record book which not contain any statement as to the quality of the seafarer’s work or as to his wages, the document as a record of his employment on board the ship. 工資 Wages 目的:確保海員根據(jù)適用的就業(yè)協(xié)議定期獲得全額工作報(bào)酬。 it does not include payments for overtime worked, bonuses, allowances, paid leave or any other additional remuneration。 a consolidated wage may include pensation for all overtime hours which are worked and all other payrelated benefits, or it may include only certain benefits in a partial consolidation。 15 hours of work means time during which seafarers are required to do work on account of the ship。 overtime means time worked in excess of the normal hours of work. 海員在船工資計(jì)算: Calculating wages of seafarers on board: 1) 海員在船期間,以每日工作 8小時(shí)為依據(jù)施行綜合計(jì)算工時(shí)制。該項(xiàng)報(bào)酬不低于適用 的《中國船員集體協(xié)議》中規(guī)定的最低工資標(biāo)準(zhǔn)。 3) 海員在船工作期間 , 遇國家法定節(jié)假日 , 公司按其基本工資的 3倍支付額外薪資 。 Seafarers remuneration poses basic pay, payments for overtime worked, paid leave, post allowances (includes concurrent post pay and allowance for berthing operation by master and officers), allowance of social security, housing subsidy and safety bonuses. 2) 海員就業(yè)協(xié)議明確說明海員為這一報(bào)酬而需工作的時(shí)間,并說明除了合并工資外可能 應(yīng)支付的任何額外津貼以及在何種情況下支付; The seafarers’ employment agreement should specify clearly, the number of hours of work expected of the seafarer in return for this remuneration, and any additional allowances which might be due in addition to the consolidated wage, and in which circumstances。 the same principle should be applied to the overtime hours included in the consolidated wage。 and 工資支付 payment made 1) 公司每月將海員的工資通過銀行匯入海員本人指定的銀行賬戶 。 The payment should be remitted to bank account nominated by seafarer. Company do not collect any charge for the service. 2) 公司向每個(gè)在船海員提供包括其應(yīng)得報(bào)酬、扣減項(xiàng)目和實(shí)付數(shù)額的工資和額外報(bào)酬的月薪賬目。 16 The currency unit is RMB. 4) 有下列情況之一的 , 公司可以代扣海員的工資 : Any of the following circumstances, Company can withhold the seafarer39。 ② 公司代扣代繳的應(yīng)由勞動(dòng)者個(gè)人負(fù)擔(dān)的各項(xiàng)社會(huì)保險(xiǎn)費(fèi)用; All social security charges withheld by Company, which should be borne by individual worker。 ④ 法律、法規(guī)規(guī)定可以海員工資中扣除的其他費(fèi)用。 Deduction from remuneration should be permitted only if: 1) 國家法律或條例或適用的集體協(xié)議有明確規(guī)定且已通過主管當(dāng)局認(rèn)為最合適的方式向海員通知了此種扣減的條件;以及 There is an express provision in national laws or regulations or in an applicable collective agreement and the seafarer has been informed, in the manner deemed most appropriate by the petent authority, of the conditions for such deductions。 The deduction does not in total exceed the limit that may have been established by national laws or regulations or collective agreements or court decisions for making such deductions。 Moary fines against seafarers other than the stipulations of abovementioned 4) should be prohibited。 Company promises that equal remuneration for work of equal value should apply to all seafarers employed on the same ship without discrimination based upon race, colour, sex, religion, political opinion, national extraction or social origin. 工作及休息時(shí)間 Hours of work and hours of rest 海員在船工作期間 , 海員的正常工時(shí)標(biāo)準(zhǔn)應(yīng)以每天 8小時(shí) , 每周休息 2天和公共節(jié)假日休息為依據(jù) ,休息時(shí)間定義應(yīng)符合船旗國規(guī)定 。 The normal working hours’ standard for seafarers, like that for other workers, shall be based on an eighthour day with 2 days of rest per week and rest on public holidays.
