If the time limit last date is a rest day or a public holiday, then the next date to the rest day or a public day shall be regarded as the final date except for the pletion date. The time limit of final day shall be 24:00 hour of the final day.除專用條款另有約定外組本錢合同的及優(yōu)先解釋順序如下：The documents in the agreement shall be mutually explanatory to ea other. Apart from those stipulated in the Particular Conditions of Agreement, the interpretation of the document in this agreement shall be according to the following order: 1〕本合同協(xié)議書Articles of Agreement2〕中標(biāo)書Notification of Award3〕及答疑The tender documents and clarification4〕本合同專用條款Particular Conditions of Agreement5〕10〕工程報(bào)價(jià)單或書 The budgetary report or project quotation合同履行包人承包人有關(guān)工程的洽商、變更等書面協(xié)議或視為本合同的組成部。雙方也可以提請(qǐng)監(jiān)理的工程師做出解釋。When there is any inconsistency or discrepancy appeared in the agreement document, both the Employer and the Contractor shall endeavor to rea settlement on the conditions that the progress of works are not affected. Both parties can also request the servision engineer to interpret the inconsistency or discrepancy arisen.In the event that both parties cannot rea mutual agreement or disagree with the interpretation of the servision engineer then the disputes shall be dealt with as per Clause 37 of the General Conditions of Agreement.語(yǔ)言文字和適用法律、及如專用條款約定使用兩種以上含兩種〕語(yǔ)言文字時(shí)漢語(yǔ)應(yīng)為解釋和說(shuō)明本合同的語(yǔ)言文字。In the minority nationalities area, the two parties can rea an agreement that the agreement to be made and interpreted in the language of a minority nationality. 適用法律和法規(guī)需要明示的法律、行政法規(guī)由雙方在專用條款中約定。適用、Standards and Codes 雙方在專用條款內(nèi)約定適用、的名稱；沒(méi)有、但有行業(yè)、的約定適用行業(yè)、的名稱；沒(méi)有和行業(yè)、的約定適用工程所在地地方、的名稱。The standards and codes to be adopted shall be agreed by the two parties in the Particular Conditions of Agreement。發(fā)包人要求使用外、的應(yīng)負(fù)責(zé)提供中文譯本。The Employer shall be responsible for any expenses incurred in purase and translation of these standards and codes or the tenical standards.圖紙 Drawings。發(fā)包人對(duì)工程有要求的應(yīng)在專用條款中提出要求措施費(fèi)用由發(fā)包人承擔(dān)承包人在約定限內(nèi)履行義務(wù)。工程質(zhì)量保修滿后除承包人存檔需要的圖紙外,應(yīng)將全部圖紙退還給發(fā)包人。The Contractor shall maintain a plete drawing in construction site, available for inspection by the engineer and relevant personnel of engineering.二、工程師按合同約定行使職權(quán)發(fā)包人在專用條款內(nèi)要求工程師在行使某些職權(quán)前需要征得發(fā)包人批準(zhǔn)的工程師應(yīng)征得發(fā)包人批準(zhǔn)。16
