【正文】 善整部環(huán)境保護法的基本結構和內容，也能與各單行法保持協(xié)調一致，發(fā)揮其在環(huán)境保護法律體系中的“憲法”作用。隨著我國社會主義市場經濟體制的逐步完善，經濟的飛速發(fā)展，環(huán)保事業(yè)的興旺和國民環(huán)境意識、法律意識的日益增強，現(xiàn)行的《環(huán)境保護法》已經不能適應時代的需要，急需進行修改。該法對保護和改善環(huán)境，促進經濟、社會和環(huán)境、資源的協(xié)調發(fā)展發(fā)揮了重要作用；為健全環(huán)境保護法律體系奠定了基礎。 【英文關鍵詞】“Environment Protection Law”； basic legal systems； harmony First， the paper states the shortages of basic legal systems. Discussions and researches are under way in kinds of forms . The paper points to the basic legal system and gives some advice on the amendment. There is not a consensus opinion on the content of basic legal systems. The paper focuses on the provisions of “Environment Protection Law”。 【關鍵詞】《環(huán)境保護法》；基本法律制度；協(xié)調 【正文】1989年，我國對原有的《環(huán)境保護法（試行）》進行了修改并頒布實施，至今已有18年。20世紀90年代以來，一批新的環(huán)境保護法律陸續(xù)制定、實施，原有的法律也都進行了大幅度的修訂。特別是其中確立的環(huán)境保護基本法律制度不健全、不完善，很大程度上制約了建立市場經濟對環(huán)境保護的規(guī)范與需要。 環(huán)境保護基本法律制度是為了實現(xiàn)環(huán)境保護法的目的、任務，按照環(huán)境法基本理念和基本原則確立的、普遍適用于環(huán)境與資源保護各個領域的法律規(guī)范的總稱。[1]各個基本制度之間相互配合形成相
