在訴訟法律制度中,行政訴訟法律制度作為監(jiān)督、制約國(guó)家行政權(quán)利、保護(hù)行政相對(duì)人合法權(quán)益的法律制度,因其特殊性而倍受司法界及民眾關(guān)注。從人權(quán)保障、權(quán)力監(jiān)督以及依法行政的角度出發(fā),行政訴訟法律制度既是一個(gè)國(guó)家民主政治制度的法律保障及集中體現(xiàn),同時(shí)也是一個(gè)國(guó)家民主政治制度的標(biāo)志及高度文明、重視人權(quán)的體現(xiàn)。我國(guó)的《行政訴訟法》在促進(jìn)依法行政、解決行政爭(zhēng)議以及維護(hù)民眾權(quán)益方面發(fā)揮了一定作用,對(duì)我國(guó)的民主政治也起到了積極的維護(hù)及促進(jìn)作用。法院獨(dú)立審判權(quán)頻繁被地方行政權(quán)干頇。《行政訴訟法》第
