When other changes have occurred in objective circumstances upon which this contract is entered into, rendering the original labor contract impossible to implement. 第三十一條 有下列情形之一且乙方無其他過失行為的,甲方不得解除本合同: Article31 Under any of the following circumstances of Party B without other misfeasance, Party A shall not terminate this labor contract arbitrarily: 乙方從事接觸職業(yè)病危害作業(yè)的未進行離 崗前職業(yè)健康檢查,或者乙方被疑似職業(yè)病病人在診斷或者醫(yī)學(xué)觀察期間的; 1. During the probation period, Party B is proved to fail to satisfy the recruitment conditions. The cases of failing to satisfy the recruitment conditions includes but not limited to the following circumstances: When Party B?s physical examination result fails to satisfy the position requirement, when Party B fails to finish the employment formalities, when Party B is not petent to the position, when Party B can not pass background research carried out by Party A, or when Party B conducts fraudulent behaviors during the recruitment process。 Article26 When changes have occurred in objective circumstances upon which this contract is entered into, rendering the original labor contract impossible to implement, both parties may amend relevant clauses of this contract. 第二十七條 經(jīng)甲、乙雙方協(xié)商一致,可以解除本合同。 Article24 During the term of this contract, Party B can not take any paid parttime job in other employer without Party A?s approval in advance. 第二十五條 甲方為乙方配備的辦公、通訊設(shè)備、交通工具及其他用品,在任何時間均歸甲方所有,乙方不得擅自處理。 Article22 Party A shall make the pany bylaws according to relevant laws and regulations and give rewards to or take disciplinary actions against Party B according to such bylaws until the dissolution of contract. 7 第二十三條 乙方應(yīng)遵守甲方的規(guī)章制度;愛護甲方的財產(chǎn),遵守職業(yè)道德;積極參加甲方組織的培訓(xùn),提高自身素質(zhì)。 Article21 Party A shall implement special labor protection to women staff and minor staff according to relevant regulations including “Provisions of Female Labor Protection”, “Provisions of Scope of Female Labor Taboo”, “Provisions of Minor Labor Protection”. 七、 勞動紀(jì)律 7. Labor Disciplines 第二十二條 甲方根據(jù)經(jīng)營需要,依法制定規(guī)章制度和勞動紀(jì)律。乙方對甲方管理人員違章指揮、強令冒險作業(yè),有權(quán)拒絕執(zhí)行;對危害生命安全和身體健康的行為,有權(quán)提出批評、檢舉和控告。 Article18 Party A shall provide Party B a safe and healthy working environment and working conditions which are equipped with necessary production facilities for ensuring the safety of Party B according to the national relevant regulations and position needs. 第十九條 甲方按照國家或當(dāng)?shù)叵嚓P(guān)部門的規(guī)定組織安排乙方進行健康檢查。 Article16 In case that Party B gets occupational disease or workrelated injuries, remuneration and medical insurance shall be executed in accordance with the national/local relevant regulation. 第十七條 其他福利待遇詳見《員工手冊》或公司相關(guān)政策制度。乙方在醫(yī)療期的工資待遇、醫(yī)療費用等按照國家和當(dāng)?shù)赜嘘P(guān)規(guī)定執(zhí)行。 Article13 Party A pays Party B?s wage monthly on the 5th of the following month. The payment can be delayed at most 5 working days under special circumstance such as force majeure events. However, Party A must inform Party B in time. 五 、 勞動保險 和 福利待遇 5. Labor Insurance and Welfare 第十四條 甲方為乙方提供商業(yè)保險,詳見公司相關(guān)政策制度。 Article11 Party A shall pay Party B?s bonus according to Party A?s business benefits and Party B?s performance at work. 第十二條 乙方應(yīng)當(dāng)依法向稅務(wù)部門繳納個人所得稅,由甲方每月按規(guī)定從乙方 5 工資中代扣代繳。 Article10 Party B39。經(jīng)協(xié)商一致,甲方可依據(jù)乙方工作能力、工作表現(xiàn)、崗位變動、身體因素等情況調(diào)整乙方工資水平。 Article8 According to the needs of production and management, Party A may extend Party B?s working hours and Party B shall obey.
