【正文】 45atradeunionmaysupervisetheemployingentityinrespectofitsobservanceoftherelevantlawsandregulationsonthepaymentofwages ，andshallhavetherighttoasktheemployingentitytomakecorrectionsforanyillegalactorcirculateanoticetothelaborandsecrrectionsortheoperatorescapes ，thetradeunioncanrepresenttheemployeestorequestthelocallaborandsecuritydepartmenttohandleitinaccordancewithlaw，andiftheemployeefilesalaborarbitrationorlawsuit ，工會組織對用人單位遵守工資支付法律、法規(guī)的情況依法進行監(jiān)督，發(fā)現(xiàn)違法行為的，用權(quán)要求用人單位改正，并及 時向勞動保障部門通報。用人單位拒不改正或者經(jīng)營者逃匿的，工會組織可以代表職工請求當(dāng)?shù)貏趧颖Ｕ喜块T依法處理，勞動者申請勞動仲裁或者提起訴訟的，工會組織應(yīng)當(dāng)依法予以支持和幫助。 ）failuretopaywagestoemployeesintheformofcurrency。 （ 3 ）failuretosettlethewagesandpayittotheemployeeinalumpsumonthedaywhenthelaborrelationshipisterminatedordischarged。（ 4 ）failuretofaithfullyformulateledgersonthepaymentofwages。or （ 5 ）四十八條用人單位有下列情形之一的，由縣級以上勞動保障部門責(zé)令限期改正；逾期未改正的，可以對用人單位處以五千元以上 第 36 頁 共 45 頁 一萬元以下的罰款，并可以對其法定代表人處以一千元以上五千元以下的罰款： （一）未依法制定工資支付制度并告知本單位全體勞動者的； （二）未以貨幣形式支付勞動者工資的； （三）未在終止或者解除勞動關(guān)系當(dāng)日結(jié)清并一次性支付勞動者工資的； （四）未如實編制工資支付臺賬的； （五）未向勞動者本人提供其工資清單的。 article49incaseanemployingentityisunderanyofthefollowingcircumstances ，thelaborandsecuritydepartmentshallseparatelyorderittopaythewagesandremunerationstotheemployeewithinthetimelimit ，paythegapbetweenthelocalminimumwagelevelandthewagesoftheemployee ，eemployingentityfailstopaywithinthetimelimit ，itmaybeorderedtopayextrapensationstotheemployeeascalculatedattherateof50%upto100%oftheamountpayable ：（ 1 ）defaultorskimpofthewagesofemployees。 （ 2 ） 第 37 頁 共 45 頁 wagespaidtoemployeesislowerthanthelocalminimumwagelevel。（ 3 ）refusaltopayorfailuretopayovertimewagestoemployeesfortheirovertimeworkorextendedworkinghoursaccordingtolaw. 第四十九條用人單位有下列情形之一的，由勞動保障部門分別責(zé)令限期支付勞動者的工資報酬、勞動者工資低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的差額、加班或者延長工作時間的工資。逾期不支付的，責(zé)令用人單位按照應(yīng)付金額百分之五十以上一倍以下的標(biāo)準(zhǔn)計算，向勞動者加付賠償金： （一）拖欠或者克扣勞動者工資的； （二）支付勞動者工資低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的； （三）拒不支付或者不按照規(guī)定支付勞動者加班或者延長工作時間工資的。 article50incaseanemployingentityisunderanyofthefollowingcircumstances ，thelaborandsecuritydepartmentshallimposeitafineof10 ，000yuanupto20， 000yuaninlightofthefollowingcircumstances：（ 1 ）refusingorimpedinganylaborandsecurityadministrativelawenforcerintheirlawfulimplementationofpublicaffairs。（ 2） 第 38 頁 共 45 頁 failingtosubmitwrittenmaterialsasrequiredbythelaborandsecuritydepartment ， disguisingthetruthoffacts ，issuingfalseevidence ，orconcealingordestroyingevidence。or （ 3 ）refusingtomakecorrectionsasorderedbythelaborandsecuritydepartment ，orrefusingtofulfillanadministrativesanctiondecisionasma列行為之一的，由勞動保障部門視情節(jié)輕重，處以一萬元以上二萬元以下的罰款： （一）拒絕、阻礙勞動保障行政執(zhí)法人員依法執(zhí)行公務(wù)的； （二）不按照勞動保障部門的要求報送書面材料、隱瞞事實真相、出具偽證或者隱匿、毀滅證據(jù)的； （三）經(jīng)勞動保障部門責(zé)令改正拒不改正，或者拒不履行勞動保障部門的行政處理決定的。 article51incaseanemployingentitydefaultsinthepaymentofwagesbyabscond ，whichmakestheemployeeshardtorecovertheirwagesandfurthercausesanyincidentthatseriouslyaffectthepublicorder ，thelegalrepresentativeoroperatorofthesaidentityshallbed 第 39 頁 共 45 頁 ealtwithbythepublicsecurityan。ifanycrimeisconstituted ，atseriouslyaffectsthepublicorderiscausedduetothedefaultorskimpofwagesbytheemployingentity ，thelegalrepresentativeormainoperatorofthesaidentityshalletothescenewithin24hoursandhelpthelaborandsecuritydepartmenttohandletheincident。ifhefailstodoso ，thelaborandsecuritydepartmentshallimposeafineof10 ，000yuanupto50， 欠工資，致使勞動者難以追償其工資而引發(fā)嚴(yán)重影響公共秩序事件的用人單位的法定代表人或者經(jīng)營者，由公安機關(guān)依法處理；構(gòu)成犯罪的，依法追究刑事責(zé)任。 因用人單位拖欠、克扣工資而引發(fā)嚴(yán)重影響公共秩序事件的，用人單位法定代表人或 者主要經(jīng)營者應(yīng)當(dāng)在二十四小時內(nèi)到現(xiàn)場協(xié)助勞動保障部門處理事件；未到現(xiàn)場的，由勞動保障部門處以一萬元以上五萬元以下罰款。 ，theprincipalandotherpersonthatisheldtobedirectlyresponsibleshallbeimposedwithadministrativesanctions ：（ 1 ）failuretoestablishthesystemofreportingillegalactsrelatedtothepaymentofwagesofemployingentities。 （ 2 ）failuretokeepsecretforinformers。 （ 3 ）failuretopromptlydealwiththereportsofemployeesorthehandlingsuggestionsasputforwardbythetradeunionpursuanttoarticle45ofthisregulation。or （ 4 ）failuretostartuptheemergencyhandlingmechanismforacollec 條例規(guī)定，有下列行為之一的，由其上級行政機關(guān)或者監(jiān)察機關(guān)責(zé)令改正；情節(jié)嚴(yán)重的，對直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員依法給予行政處分： （一）未建立用人單位工資支付違法行為舉報制度的； （二）未為舉報人保密的； （三）未依法及時處理勞動者舉報或者工會組織按照本條例第四十五條規(guī)定提出的處理建議的； （四）發(fā)生群體性事件，未啟動應(yīng)急預(yù)案的。 第 41 頁 共 45 頁 article53
