【正文】 他語言發(fā)言，記錄則應(yīng)當(dāng)用歐洲專利局正式語言翻譯。對歐洲專利申請或歐洲專利說明書或權(quán)利要求書部分的修改，用程序中語言，或在程序中語言改變時，用程序中最初用語言。Rule 3(deleted)Rule 4Language of a European divisional application第四條　歐洲專利分案申請的語言European divisional applications or, in the case referred to in Article 14, paragraph 2, the translations thereof, must be filed in the language of the proceedings for the earlier European patent application.每件歐洲專利分案申請或在第十四條第二款的情況下，該申請的譯文應(yīng)用在先歐洲專利申請的程序中最初用語言提出。Rule 5Certification of translations第五條　譯文的證明When a translation of any document must be filed, the European Patent Office may require the filing of a certificate that the translation corresponds to the original text within a period to be determined by it. Failure to file the certificate in due time shall lead to the document being deemed not to have been received unless the Convention provides otherwise.在對一份申請文件進(jìn)行翻譯時，歐洲專利局可以要求在其規(guī)定的期限內(nèi)證明譯文原文相符。如未在規(guī)定期限內(nèi)提出證明，該文件應(yīng)被視為未受理。除非本公約有相反規(guī)定。Rule 6Time limits and reduction of fees第六條　期限和費用的減收(1) The translation referred to in Article 14, paragraph 2, must be filed within three months after the filing of the European patent application, but no later than thirteen months after the date of priority. Nevertheless, if the translation concerns a European divisional application or a new European patent application under Article 61, paragraph 1(b), the translation may be filed at any time within one month of the filing of such application.（１）第十四條第二款所指的譯文應(yīng)在提出歐洲專利申請后的三個月內(nèi)，或在自優(yōu)先權(quán)日起的十三個月內(nèi)提交。但是第六十一條第一款（ｂ）項所規(guī)定的歐洲專利分案申請或歐洲專利新申請的譯文，可在提出該申請后的一個月內(nèi)提交。(2) The translation referred to in Article 14, paragraph 4, must be filed within one month of the filing of the document. Where the document is a notice of opposition or an appeal, this period shall be extended where appropriate to the end of the opposition period or appeal period.（２）第十四條第四款所指的譯文應(yīng)自申請日起一個月內(nèi)提交。如該文件是異議通知書或申訴書，該期限在必要時可延長至異議期或申訴期結(jié)束。(3) A reduction in the filing fee, examination fee, opposition fee or appeal fee shall be allowed an applicant, proprietor or opponent, as the case may be, who avails himself of the options provided in Article 14, paragraphs 2 and 4. The reduction shall be fixed in the Rules relating to Fees at a percentage of the total of the fees.（３）對于享有第十四條第二、第四款規(guī)定的選擇權(quán)的專利申請人，專利權(quán)人或異議人，可分別減少申請費、審查費、異議費或申訴費。按收費條例規(guī)定百分比，對上述費用減收。Rule 7Legal authenticity of the translation of theEuropean patent application第七條　歐洲專利申請譯文的法律或申訴費真實性Saving proof to the contrary, the European Patent Office may, for the purposes of determining whether the subjectmatter of the European patent application or European patent extends beyond the content of the European patent application as filed, assume that the translation referred to in Article 14, paragraph 2, is in conformity with the original text of the application.除非有相反的證明，歐洲專利局在考慮是否歐洲專利申請或歐洲專利的內(nèi)容超出了該申請?zhí)岢鰰r的內(nèi)容時，把第十四條第二款所指的譯文視為與原申請書相符。Chapter IIOrganisation of the European Patent Office第二章　歐洲專利局的機(jī)構(gòu)Rule 8Patent classification第八條　專利分類(1) The European Patent Office shall use:（１）歐洲專利局：(a) the classification referred to in Article 1 of the European Convention on the International Classification of Patents for Invention of 19 December 1954 until the entry into force of the Strasbourg Agreement concerning the International Patent Classification of 24 March 1971,2ａ）直至一九七一年三月二十四日國際專利分案斯特拉斯堡協(xié)定生效時前，使用一九五四年十二月十九日關(guān)于發(fā)明專利國際分類歐洲公約第一條所指的分類法；(b) the classification referred to in Article 1 of the aforementioned Strasbourg Agreement, after the entry into force of that Agreement.ｂ）在上述協(xié)定生效后，使用該協(xié)定第一條規(guī)定的分類法。(2) The classification referred to in paragraph 1 is hereinafter referred to as the international classification.（２）本條第一款所指的分類法，下稱國際分類法。Rule 9Allocation of duties to the departments of the first instance第九條　第一級機(jī)構(gòu)的職責(zé)范圍(1) The President of the European Patent Office shall determine the number of Search Divisions, Examining Divisions and Opposition Divisions. He shall allocate duties to these departments by reference to the international classification and shall decide where necessary on the classification of a European patent application or a European patent in accordance with that classification.（１）歐洲專利局局長決定檢索、審查及異議部門的數(shù)量，并根據(jù)國際分類法劃分上述各部門的職責(zé)范圍，以及在必要時決定用國際分類法對一件歐洲專利申請或一件歐洲專利進(jìn)行分類。(2) In addition to the responsibilities vested in them under the Convention, the President of the European Patent Office may allocate further duties to the Receiving Section, Search Divisions, Examining Divisions, Opposition Divisions and the Legal Division.（２）除了公約規(guī)定的職責(zé)范圍以外，歐洲專利局局長可以給予受理處、檢索部、審查部、異議部和法律部其他任務(wù)。(3) The President of the European Patent Office may entrust to employees who are not technically or legally qualified examiners the execution of individual duties falling to the Examining Divisions or Opposition Divisions and involving no technical or legal difficulties.（３）歐洲專利局局長可以將屬于審查部或異議部的，然而并非特別困難的技術(shù)或法律工作交給一些在技術(shù)上或法律上尚不合格的審查員。(4) The President of the European Patent Office may grant exclusive responsibilities to one of the registries of the Opposition Divisions for fixing the amount of costs as provided for in Article 104, paragraph 2.（４）歐洲專利局局長可以授予異議部一名書記員以職權(quán)，讓其決定第一百零四條第二款中所指的費用。Rule 10Presidium of the Boards of Appeal第十條　第二級機(jī)構(gòu)的職責(zé)范圍及其成員的指定(1) The autonomous authority within the organisational unit prising the Boards of Appeal (the “Presidium of the Boards of Appeal”) shall consist of the VicePresident in charge of the Boards of Appeal, who shall act as chairman, and twelve members of the Boards of Appeal, six being Chairmen and six being other members. （１）在每一工作年開始之前，都要確定各申訴委員會的管轄范圍，并指定申訴委員會及擴(kuò)大申訴委員會的正式成員和候補成員。任何申訴委員會的成員都可被指定為許多申訴委員會的成員。如需要，可在該工作年間對此類做法加以修改。(2) All members of the Presidium shall be elected by the Chairmen and members of the Boards of Appeal for one working year.
