【正文】 、毒品、金融詐騙、非法集資和恐怖活動(dòng)等犯罪活動(dòng)的過程中，對(duì)反洗錢和反非法融資要求越高。 ：中國金融業(yè)目前是混合操作獨(dú)立運(yùn)營管理模式的主要過渡階段 ,相應(yīng)的監(jiān)管仍然主要是分業(yè)監(jiān)管 。 雖然我國的反洗錢工作目前已取得很大進(jìn)展，但是也同時(shí)面臨很多的問題，有待一步步解決。 ：目前主要有兩點(diǎn)，一是信息監(jiān)測不能完全覆蓋金融機(jī)構(gòu)洗錢風(fēng)險(xiǎn)；二是監(jiān)測信息標(biāo)準(zhǔn)不夠規(guī)范。 進(jìn)一步規(guī)范：這些年來，隨著我國經(jīng)濟(jì)的快速發(fā)展和國外交流的更加開放，我國的金融環(huán)境在外來企業(yè)的侵蝕下越發(fā)岌岌可危，特別是跨國犯罪集團(tuán)和洗錢有關(guān)恐怖組織的滲入，給我國經(jīng)濟(jì)運(yùn)行的環(huán)境造成極大的負(fù)面影響。反觀國際上許多發(fā)達(dá)國家 ,因?yàn)槠浞聪村X工作進(jìn)行得很早 ,所以也有很多值得我國借鑒的地方。美國在 2021 年出臺(tái)的最重要的反洗錢法律 —— 美國愛國者法案。為了適應(yīng)反洗錢的國際趨勢 ,1993 年發(fā)布了 1993 年《刑事司法令》 ,它對(duì) 1986 年毒品走私犯罪條例進(jìn)行了比較大的調(diào)整 ,洗錢犯罪處罰擴(kuò)大到一般犯罪 。立法和政策制定機(jī)構(gòu) 主要有兩種設(shè)置模式：分散設(shè)置模式和專門設(shè)置模式。 國外中央銀行反洗錢體系對(duì)我國的借鑒作用 總結(jié)歐美等各國發(fā)達(dá)國家的反洗錢經(jīng)驗(yàn)，有效的反洗錢組織框架應(yīng)該符合三個(gè)最基本的要求 :機(jī)構(gòu)功能清晰 ,分工明確 ,機(jī)構(gòu)密切協(xié)調(diào) ,包括與橫向和縱向合作組織 ,機(jī)構(gòu)的信息數(shù)據(jù)處理、分析 ,相傳。模式 3:將當(dāng)前央行反洗錢監(jiān)測分析中心反洗錢局平移至最高人民檢察院 。因此，考慮到近期效率和長遠(yuǎn)效果，我覺得第一種模式是目前我國反洗錢組織架構(gòu)改革的最佳選擇。第一層次是法律層面 ,建議反洗錢法律 ,銀行保密法 ,現(xiàn)金交易 ,外匯管理。第二是建立一個(gè)報(bào)告大額交易和可疑外匯交易在外匯和識(shí)別標(biāo)準(zhǔn)系統(tǒng)的參數(shù) ,優(yōu)化反洗錢識(shí)別指標(biāo)。反洗錢內(nèi)部控制制度指的是國務(wù)院有關(guān)管理機(jī)構(gòu)對(duì)底下金融機(jī)構(gòu)提出的一種內(nèi)部監(jiān)控制度。根據(jù)新頒布反洗錢法，適時(shí)對(duì)相關(guān)《刑法》、《中國人民銀行法》等根據(jù)反洗錢統(tǒng)一修改規(guī)范完善。我國 2021 年十屆全國人大常委會(huì)第二十四次會(huì)議通過并于 2021 年 1 月 1 日起實(shí)施的《中華人民共和國反洗錢法》，對(duì)于我國的反洗錢工作有著里程碑式的作用。還得在涉及到有違法犯罪分子或者恐怖分子和跨國洗錢集團(tuán)侵入我國經(jīng)濟(jì)系統(tǒng)時(shí)，配合國際司法和刑警調(diào)查，并積極提供線索與我國人力物力支持。許多學(xué)者也從不同的角度來探討反洗錢工作展開中存在的問題以及探索更加適合本國反洗錢工作的對(duì)策和思路，有利于我國反洗錢工作更加順利地進(jìn)行，也對(duì)這類理論的完善起到借鑒作用。本人寫此論文不求超越前輩們對(duì)此論題的研究，只求在此基礎(chǔ)上提出自己小小的見解，也為此論題的理論完善貢獻(xiàn)自己微薄的力量。 我要感謝我的導(dǎo)師 謝湘生和許朝暉 老師。 我還要感謝我的班主任劉沛老師以及在大學(xué)四年中給我們授課的所有老師們，是他們讓我學(xué)到了很多很多知識(shí)，讓我看到了世界的精彩，讓我學(xué)會(huì)了為人處事。80s.
