Engineers and Employer’s Representative 工程師和發(fā)包人代表 Page １２ of 55 The Engineers shall exercise them rights within the scope as agreed under the Particular Terms of the Contract。承包人不得將圖紙用于與工程無關的用途。雙方有約定標準的，應首先適用約定的標準。 Applicable Standards and Specifications 適用標準、規(guī)范 Page １１ of 55 The Employer and the Contractor shall specify the names of the applicable national standards and specifications in the Contract。 3. Language and Applicable Laws, Standards and Specifications. 語言文字和適用法律、標準及規(guī)范。時限的最后一天是休息日或者其他法定節(jié)假日的，以節(jié)假日次日為時限的最后一天，但竣工日期除外。 Claim: The claim against the other Party for economic pensation and/or extending Page ９ of 55 the Project Period for the actual losses that are caused not due to his fault, but due to a reason attributable to the other Party during the performance of this Contract. 索賠：指在合同履行過程中，對于并非自己的過錯，而是應由對方承擔責任的情況造成的實際損失，向對方提出經(jīng)濟補償和（或）工期順延的要求。 The Drawings: Any and all the drawings satisfactory to the construction requirements of the Contractor (including accessorial instructions and related materials), which are presented by the Employer. 圖紙：指由發(fā)包人提供的，滿足承包人施工需要的任何及所有圖紙（包括配套說明和有關資料）。 Expenses: The economic expenditure excluded in the Contract Price and to be born by either the Employer or by the Contractor. 費用：指不包含在合同價款之內的應當由發(fā)包人或承包人承擔的經(jīng)濟支出。 Project Price Governing Authority: The relevant department of the State Council, the construction administrative departments of the local government at or above the county level or the project price governing institute as authorized by the above mentioned departments . 工程造價管理部門：指國務院有關部門、縣級以上人民政府建設行政主管部門或其委托的工程造價管理機構。 The Engineers: The general supervision engineer appointed by the Supervisor and the onsite representative of TKS Bauplanung GmbH (which is the designated consultant of the Employer).Their identity and authority will be specified by the Employer and the Contractor in the Particular Terms of the Contract.
