【正文】 1 裝修 裝飾工程施工合同 CONTRACT OF DECORATION ENGINEERING 簽署日期 Date of 工程名稱 ： Project Name: 工程地址 ： Project Place: 發(fā)包方 (甲方 )： Owner (Hereinafter referred to as party A) 承包方 (乙方 )： Contractor: (hereinafter called party B) 鑒于甲方擬對辦公樓進行裝修裝飾，通過招投標 程序 ，將該工程授予乙方施工并完成； 鑒于乙方具備裝修裝飾施工的資質，并愿意接受招投標 規(guī)定的條件，同意承擔該工程的施工并完成； 鑒于 雙方同意 遵照 《中華人民共和國合同法》、《建筑裝飾裝修管理規(guī)定》、《住宅室內(nèi)裝飾裝修管理辦法》及有關法律、法規(guī)規(guī)定 履行本合同； 基于本合同之合意、聲明、約定及其它約因，雙方當事人茲就下列各事項達成協(xié)議： WHEREAS party A intends to make decoration of office building, through bidding procedure, award this project hereby to party B for construction and pletion thereof. WHEREAS party B is with the qualification of decoration engineering, intends to accept bidding conditions and consent to undertake the project construction and plete. WHEREAS parties hereto agree to execute this contract in accordance with LAW OF CONTRACT, REGULATIONS OF CONSTRUCTION DECORATION MANAGEMENT, ADMINISTRATION RULES FOR INDOOR HOME DECORATION and concerned laws and regulations. NOW THEREFORE in consideration of the mutual promises, assertions and covenants herein and other good and valuable considerations, the receipts of which is acknowledged hereby, the parties hereby agree as follows: 第一條 工程概況 Work Overview 工程名稱 ： Project Name 工程地址 ： Project Place: 承包方式：總承包（包工包料，包質量，包安全，包工期） Contracting Means: General contracting, including contracting of materials and labor, liabilities of quality, work’s safety and work’s schedule. 承包內(nèi)容：包括所有的拆除及改造工程，以附件《工程報價單》為準。 Contracting contents include all works of demolishment and modification, which should be subject to Construction Quotation. 第二條 合同工期 Project Period 2 本合同的工期自 年 月 日開工至 年 月 日竣工。 Project period hereof is from the date of mencement of to the date of pletion of . 第三條 裝修審批和資質 Approval of Project and Qualification of Construction 除本合同另有規(guī)定外，乙方同意依法辦理與裝修有關的所有審批、登記及驗收手續(xù) ，包括消防手續(xù)。 Unless otherwise provided herein party B agree to process all formalities, which are related to this decoration, of the approval, registration and acceptance in addition to fire protection. 乙方保證，其具備 符合本工程要求的 施工 資質。本合同項下甲方發(fā)包給乙方的所有裝修工程均沒有超出乙方資質證書規(guī)定的范圍。 Party B hereby warranty that its execution qualification conform to this project requirements and none of decoration works hereunder, which are awarded by party A, are beyond the scope of party B’s Certification of Qualification. 第四條 工程價款及付款方式 Project Cost and Payment 本工程合同價款為人民幣： 元整。 The cost of this project is Yuan RMB only. 付款方式： Payment by （ 1）在乙方如期完成全部的裝修施工工程并經(jīng) 甲方根據(jù)第八條驗收合格后，甲方將于收到乙方正式發(fā)票后 30 天內(nèi)按實際完成的工作量及投標單價 一次性 結算支付 全部工程款項 。 Upon and after party B’s pletion of all decoration works on schedule and making acceptance by party A pursuant to the stipulation of Article 8, party A will , within 30 days of receipt of formal invoice from party B, effect payment in a lump sum of all project amount in accordance with actual pletion of works and bidding unit price. （ 2）由于設計變更及甲方要求修改等而引起的工程量較大的增減時，須由乙方編制增減工程預算書，經(jīng)甲方審核確認后，在相應的工程進度款付款時予以結算支付。 Provided that larger increase or decrease of quantity due to design modification and / or party A’s requirement thereof, should be subject to party B’s preparation of engineering budget for the increase or decrease of quantity, which should be reviewed and examined by party A before payment of project progress be settled an paid correspondently. 乙方向甲方提供正式稅務發(fā)票前，甲方?jīng)]有付款義務。 Party A will not effect payment until and unless party B have provide the formal invoice to party A. 第五條 工程質量要求 Requirements of Project Quality 乙方嚴格按照經(jīng)甲方確認的施工圖紙進行施工，隨時接受甲方代表或委派人員的檢查檢驗，為檢查檢驗提供便利條件。同時施工嚴格按照國家規(guī)范進行，施工滿足設計要求，質量達到工程建設強制性標準、其他技術標準以及本合同的規(guī)定。否則，甲方有權要求乙方拆除重建，由此產(chǎn)生的一切費用和損失，包括工期延誤的損失，由乙方承擔。 Party B should, pursuant to in strict the drawings which confirmed by party A, carry out execution and accept in any time the inspection / checking by party A’s representative or designated 3 personnel, for which provide the facilitate conditions. Otherwise party A is entitle to require party B to dismantle and reconstruct the work from which any and all expense and loss should be undertaken by party B. 工程以包工包料的方式進行，材料按甲方指定采購，并應當符合國家標準及環(huán)保要求。禁止使用國家明令淘汰的建筑裝修裝飾材料和設備。 This project is processed by the means of contracting materials and labor, respecting to material which should be purchased under party A named and conform to the requirements of State’s standards and environmental protection. The materials of decoration and equipments , which have been eliminated expressly by State is prohibited to used. 乙方對設計方案的可實施性和安全性承擔全部責任，任何因設計方案無法實施，修改方案導致的費用增加 , 以及不能通過消防等相關驗收而引起的損失或費用增加均由乙方承擔。 Party B should be take full
