As the claim relates to the immediate interests of owners and contractors been attached great importance to both sides, coupled with the current engineering contracting market petition, low bid has bee a mon phenomenon, making the project claim it is particularly important.Key Words: Engineering claims。 engineering classification of the claim。 the project claim the cost of the position and method1前 言近年來，合同管理和索賠越來越受到我國工程界的重視，正在逐步推廣開來。但是，目前在我國，索賠意識薄弱、索賠管理水平低仍是我國建筑企業(yè)的普遍現(xiàn)象。我國法律尚不健全，有法不依現(xiàn)象十分嚴重，合同的法律環(huán)境不是很好，人們也不習慣用法律手段和合同措施解決問題。關(guān)于索賠問題，在合同簽訂和實施中問題較多，索賠管理的成效不很顯著，水平也很難提高。我國目前建筑市場競爭非常激烈，過于向買方傾斜，業(yè)主在合同中經(jīng)常會提出較為苛刻的合同條件，而承包商迫于生計，只能接受這樣的合同條件。在工程中，承包商處于被動地位，常常為了搞好關(guān)系，而不能認真執(zhí)行合同，不敢向業(yè)主提出合理的索賠要求，即使承包商想嚴格執(zhí)行合同，由于各方面的原因，也無法達到目的。承包商面臨十分不利的合同簽訂和實施環(huán)境。在合同的簽訂和執(zhí)行過程中，雙方的非理性行為惡化著工程承包市場環(huán)境。我國
