【正文】 庫房(㎡)出租給乙方使用,作為乙方經(jīng)營辦公場所。根據(jù)《中華人民共和國合同法》、《城市房屋租賃管理辦法》等有關(guān)法律、法規(guī)的規(guī)定,為明確甲、乙雙方的權(quán)利、義務(wù)關(guān)系,經(jīng)甲、乙雙方友好協(xié)商一致,特訂立本合同,以資共同信守。方便。 租賃期屆滿,甲方有權(quán)收回租賃房屋, 乙方應(yīng)如期歸還。經(jīng)雙方達(dá)成協(xié)議,重新簽訂租賃合同,乙方依法享有優(yōu)先承租權(quán)。租金及相關(guān)費(fèi)用的支付3.1租賃費(fèi)用:年租金為人民幣元整。每期交納租金的截止日期分別為:甲方的帳戶信息如下: 收款人:開戶銀行:帳號:3.2其它費(fèi)用(1)、乙方若需使用電話、傳真、寬帶、有線電視及其他甲方已預(yù)留接口之設(shè)施,有關(guān)接通或安裝使用等費(fèi)用由乙方自行承擔(dān)。(3)、租金中未含冬季取暖費(fèi),冬季取暖費(fèi)由乙方按照供熱機(jī)構(gòu)之規(guī)定,繳納給甲方。該等費(fèi)用的標(biāo)準(zhǔn)按照收取該等費(fèi)用的有關(guān)機(jī)構(gòu)確定的標(biāo)準(zhǔn)執(zhí)行。所有權(quán)屬于乙方的設(shè)備、設(shè)施和經(jīng)營責(zé)任,其保險責(zé)任歸乙方。乙方須嚴(yán)格遵守中國制定的有關(guān)租賃房屋及乙方在租賃房屋內(nèi)進(jìn)行其業(yè)務(wù)的政策和法規(guī)。4.2甲方有義務(wù)保證乙方在本合同存續(xù)期間,按本合同確定的使用用途,正常使用租賃房屋和相應(yīng)設(shè)施。租賃房屋的裝修及維護(hù)5.1租賃期內(nèi),租賃房屋的裝修費(fèi)由乙方自行承擔(dān)。合同解除后,能移動并不破壞房屋外觀及內(nèi)部結(jié)構(gòu)的部分由乙方拆起。5.3乙方對租賃房屋的任何改建均需得到甲方的書面許可。5.5甲方在暫?;虿粫和W赓U房屋內(nèi)任何設(shè)施的使用的情況下進(jìn)入租賃房屋進(jìn)行維修,但應(yīng)事先征得乙方同意。甲方的陳述與保證6.1保證其作為本合同簽約人依法成立、依法存續(xù),具備簽訂本合同的主體資格。6.3保證租賃房屋具備出租的合法條件,并保證該合法條件在合同期內(nèi)持續(xù)存在。7.乙方的陳述與保證7.1及時、足額地繳付本合同規(guī)定的租金及相關(guān)費(fèi)用及其他一切費(fèi)用。7.3保持租賃房屋內(nèi)部清潔完好,乙方對所租房間的損害,以及對乙方或其客人造成的公用地段的損害,甲方修復(fù)時的費(fèi)用由乙方如數(shù)繳付。7.5如乙方不履行或違反本合同的任何條款、規(guī)定或條件,而使租賃房屋遭受損失,被罰款或造成甲方的其他支出,在甲方開出單據(jù)的五天內(nèi),乙方應(yīng)如數(shù)補(bǔ)償或賠償甲方。7.7不得在租賃房屋內(nèi)進(jìn)行,允許、默認(rèn)任何可能對甲方造成損害的活動。7.9乙方在經(jīng)營期間必須投保。8.合同終止與解除8.1本合同于有效期滿之日終止。8.3租賃期內(nèi),如因不可抗力(且不可抗力延續(xù)兩個月),法律政策變化以及政府城市規(guī)劃等原因致使合同無法履行,則本合同可以終止。8.4因甲、乙雙方任何一方違約而解除合同,如果違約方在收到守約方一書面糾正通知后15日內(nèi)未進(jìn)行任何補(bǔ)救措施或與守約方達(dá)成新的協(xié)商安排,則守約方可以隨時向違約方發(fā)出解約的通知,解約通知自送達(dá)違約方之日起生效。通知與聯(lián)絡(luò)1雙方各指定本合同文首列明的聯(lián)系人負(fù)責(zé)收發(fā)相關(guān)通知、就本合同履行相關(guān)事宜傳遞信息并進(jìn)行必要的協(xié)調(diào)。任何一方在未收到前述人員變更通知前按照原來的聯(lián)絡(luò)人及聯(lián)系方式發(fā)出的相關(guān)通知均為有效通知。10.征用及不可抗力10.1由于政府征用土地因素導(dǎo)致本合同被迫終止時,本合同則自政府征用之日起終止執(zhí)行,但乙方應(yīng)支付自起租日始至政府征用日止的租金及相關(guān)費(fèi)用。10.2不可抗力是指嚴(yán)重自然災(zāi)害及其他本合同雙方在訂立本合同時人力不能預(yù)見,其發(fā)生或后果不能避免且不能克服的事件。遭受不可抗力一方在不可抗力事件發(fā)生后的15天內(nèi),應(yīng)向另一方出具經(jīng)不可抗力發(fā)生地公證機(jī)構(gòu)公證的有關(guān)權(quán)威部門的證明。發(fā)生不可抗力,對于事故前雙方發(fā)生的經(jīng)濟(jì)上的義務(wù)不受影響。如屬雙方的過失,應(yīng)根據(jù)情況,由甲、乙雙方分別承擔(dān)違約責(zé)任。(2)從違約之日起,甲方可以單方解除本合同或變更本合同。如甲、乙雙方中任何一方有違約行為,另一方可以書面形式通知其糾正,并進(jìn)行友好協(xié)商,解決違約問題。13.附則:13.1合同有效期限內(nèi),如任何一方由于改制、合并、分立等發(fā)生變更,則由變更后的主體承繼該方在本合同項下之各項權(quán)利義務(wù)。13.3本合同未盡事宜,甲、乙雙方可簽訂補(bǔ)充協(xié)議,補(bǔ)充協(xié)議與本合同具有同等法律效力。13.4任何一方對另一方違反合同的態(tài)度或疏忽都不應(yīng)視為其放棄權(quán)利。13.5本合同及附件正本一式份,甲、乙雙方各持有份,具有同等法律效力。13.7在簽署本合同前,甲、乙雙方須持有中國政府簽署的營業(yè)執(zhí)照或具有法律效力證明文件的復(fù)印件作為本合同的附件。本合同附件的明細(xì)表: 甲方提供相關(guān)資料: 乙方提供相關(guān)資料: 甲方蓋章:法人代表:乙方蓋章:法人代表:****年**月**日****年**月**日Lease AgreementThe lease agreement is executed as ofby and between:Lessor:Registered Address: Legal representative: Contact Address: Post Code: Telephone: Facsimile:Lessee:Registered Address: Legal representative: Contact Address: Post Code: Telephone: Facsimile:whereas: to provisions of laws, Party A is entitled to lease the premises located at _______South Road West Third Ring, Fengtai District, Beijingrooms of second floor of Party A’s office building and a warehouse(㎡)to Party B for the purpose of its is understood that Party B pletely acknowledge the lease procedure and enter into the agreement by itself and fulfill to Contract Law of PRC, Administrative Measures for Municipality on House Tenancy and provisions of relevant laws and regulations, after friendly negotiation between Party A and Party B, both parties have reached agreement in order to clarify the rights and obligations of both parties and fulfill it on good Party A agrees to lease and Party B agree to rent pursuant to terms and conditions under this agreement,rooms of second floor of Party A’s office building and a warehouse(500㎡)located at _____South Road West Third Ring, Fengtai District, Beijing(hereinafter refer to as “premises”).
