Party B shall be responsible for the immediate repair or pensation for the damage to the Premises or facilities due to Party B’s improper use.63租賃期間,甲方督促物業(yè)管理公司保證該房屋及附屬設(shè)施處于正常的使用和安全的狀態(tài)。檢查養(yǎng)護(hù)時(shí),乙方應(yīng)予以配合。63 Party A shall guarantee that the Premises shall be under the condition of usable and safety during the leasing term. Party A shall notice Party B one (1) day in advance while repairing maintenance Premises. Party B shall assist or cooperate with Party A . Party A shall reduce the influence of Party B’s using of the Premises.64 除本合同附件(三)外,乙方另需裝修或者增設(shè)附屬設(shè)施和設(shè)備的,應(yīng)事先征得甲方的書面同意,按規(guī)定須向有關(guān)部門審批的,則還應(yīng)由 甲方委托乙方 報(bào)請有關(guān)部門批準(zhǔn)后,方可進(jìn)行。(詳見補(bǔ)充條款)71 Except that Party A agrees Party B extends this contract, Party B shall return the Premises at the expiration of the leasing term. While returning, the Premises shall be checked for acceptance and the two parties shall pay up the charges ought to be borne by each other.八、轉(zhuǎn)租、轉(zhuǎn)讓和交換Eight、Subletting, transfer and exchange81除甲方已在本合同補(bǔ)充條款中同意乙方轉(zhuǎn)租外,乙方在租賃期內(nèi),需事先征得甲方的書面同意,方可將該房屋部分或全部轉(zhuǎn)讓給他人。81 Party B shall be allowed to sublet the premises in part or in whole to third Party only after getting Party A39。82 When Party B sublets the Premises, Party B shall conclude written subleasing Contract with the sub lessee and register in the premises transaction center of district/country or acceptance bureau of farm system where the premises locate in accordance with regulations.83在租賃期內(nèi),乙方將該房屋轉(zhuǎn)讓給他人承租或與他人承擔(dān)的房屋進(jìn)行交換,必須事先征得甲方書面同意。83 During leasing term, Party B shall not sublease the premises to third Party or exchange it with third Party unless a written consent from Party A has be granted. After subletting, the successor of the lease right of the Premises shall execute a principal part alteration contract with Party A and continue to fulfill this contract.84在租賃期內(nèi),甲方如需出售該房屋,應(yīng)提前三個(gè)月通知乙方。轉(zhuǎn)讓后,甲方應(yīng)保證受讓人與乙方簽定租賃主體變更合同并繼續(xù)履行本合同。91 During the leasing term, the contract shall be terminated when any of the following condition occurs and two parties shall not be responsible for each other.(一)該房屋占用范圍內(nèi)的土地使用權(quán)依法提前收回的;(a) The right to the use of land on which the Premises locate be legally taken back in advance。(三) 該房屋毀損、滅失或者被鑒定為危險(xiǎn)房屋的;(c) The Premises be damaged, missing or be authenticated as dangerous Premises。違反本合同的一方,應(yīng)向另一方按月租金的 兩 倍支付違約金;給對方造成損失的,支付的違約金不足抵付一方損失的,還應(yīng)賠償造成的損失與違約金的差額部分:92 The both sides agree that One Party shall inform the other Party in written to terminate the Contract under the following conditions. The defaulting Party shall pay to the other Party the liquidated damages equivalent to two(2) times of the monthly rent. If the financial losses incurred to the other Party exceed the amount of the liquidated damages, the defaulting Party shall pensate the deficiency.(一)甲方未按時(shí)交付該房屋,經(jīng)乙方催告后 拾伍 日內(nèi)仍未交付的;(a) Party A fails to deliver the Premises on schedule and fails to do so within fifteen(15) days after reception of Party B’s summon exhortation. (二)甲方交付的該房屋不符合本合同的約定,致使不能實(shí)現(xiàn)租賃目的的;或甲方交付的房屋存在缺陷,危及乙方安全的。(四)因乙方原因造成房屋主體結(jié)構(gòu)損壞的;(d) The damage of main structure of the Property caused by Party B。(六)乙方逾期不支付租金累計(jì)超過 壹 個(gè)月的; (f) Party B fails to pay the rent on schedule for longer than one(1) month。 101 if the Premises has defect when delivering, Party A shall repair the Premises within ten(10) days.
