【正文】 約情況下，自身處于不利地位。同時，現(xiàn)有的合同文本對管理環(huán)節(jié)和工程實施過程中可能出現(xiàn)的各種問題缺少相應(yīng)的規(guī)定，而且對一些基本要約也未作出明確規(guī)定，承、發(fā)包雙方存在鉆合同文本漏洞的情形。例如：發(fā)包方暗中以墊資為條件，違法發(fā)包；不按照合同約定支付工程進度款；工程驗收合格后，不及時辦理賬務(wù)結(jié)算，拒付工程款等。例如，有些承包商在自身不具備項目施工資質(zhì)的情況下，為達到承包工程的目的，非法向發(fā)包人行賄或者假借其他有承包資質(zhì)企業(yè)的名義進行虛假投標。承、發(fā)包雙方的行為不規(guī)范2008年12月，重慶市建委抽查在建房屋建筑和市政基礎(chǔ)設(shè)施工程施工現(xiàn)場79個，發(fā)現(xiàn)有70％合同不規(guī)范，一旦這些工程發(fā)生糾紛，建筑企業(yè)必將承擔許多隱形的風險和損失。國家工商局和建設(shè)部雖然制定了《建筑工程施工合同示范文本》，但有些建筑企業(yè)在簽署合同時不依據(jù)此合同文本，內(nèi)容不全，對權(quán)責和義務(wù)的規(guī)定不明確39。 所以，在工程建設(shè)過程中，業(yè)主和承包商皆做好工程索賠管理工作，都十分重要。 現(xiàn)在，市場經(jīng)濟的利益驅(qū)動規(guī)律，承包商為了取得工程的承包權(quán)有時不得不以壓低價格，或額外承諾其它優(yōu)惠條件，獲取中標，而在工程實施過程中通過索賠再增加合同造谷。關(guān)鍵詞：建筑工程合同管理 工程索賠 索賠的內(nèi)容與實現(xiàn)Theory analysis in the process of construction contract management and the project claimAbstractThis article expounds and analyzes the present situation of the construction project contract management and the existing problems, on the basis of this puts forward the effective measures to improve construction project contract management has certain practical significance and reference value.
