Advice of Acceptance承兌通知 The collecting bank must send without delay advice of acceptance to the bank from which the collection instruction was received. 代收行必須無延誤地對向其發(fā)出托收指示的銀行寄送承兌通知; iii. Advice of Nonpayment and/or Nonacceptance不付款或不承兌的通知 The presenting bank should endeavour to ascertain the reasons for nonpayment and/or nonacceptance and advise accordingly, without delay, the bank from which it received the collection instruction. The presenting bank must send without delay advice of nonpayment and/or advice of nonacceptance to the bank form which it received the collection instruction. On receipt of such advice the remitting bank must give appropriate instructions as to the further handling of the documents. If such instructions are not received by the presenting bank within 60 days after its advice of nonpayment and/or nonacceptance, the documents may be returned to the bank from which the collection instruction was received without any further responsibility on the part of the presenting bank 提示行應(yīng)盡力查明不付款或不承兌的原因,并據(jù)以向?qū)ζ浒l(fā)出托收指示的銀行無延誤地寄送通知。在無該項指示時,代收行將自行選擇通知方法寄送有關(guān)的通知,而其費用應(yīng)由向其發(fā)出托收指示的銀行承擔(dān)。 Article 26 Advices Collecting banks are to advise fate in accordance with the following rules: 代收行應(yīng)按下列規(guī)則通知托收狀況: a. Form of Advise通知格式 All advices of information from the collecting bank to the bank from which the collection instruction was received, must bear appropriate details including, in all cases, the latter bank’s reference as stated in the collection instruction. 代收行對向其發(fā)出托收指示的銀行給予所有通知和信息必須要有相應(yīng)的詳情,在任何情況下都應(yīng)包括后者在托收指示中列明的銀行業(yè)務(wù)編號?! rticle 25 CaseofNeed預(yù)備人 If the principal nominates a representative to act as caseofneed in the event of nonpayment and/or nonacceptance the collection instruction should clearly and fully indicate the powers of such caseofneed. In the absence of such indication banks will not accept any instructions from the caseofneed. 如果委托人指定一名代表作為在發(fā)生不付款和(或)不承兌時的預(yù)備人,托收指示中應(yīng)清楚地、詳盡地指明該預(yù)備人的權(quán)限?! rticle 24 Protest拒絕證書 The collection instruction should give specific instructions regarding protest (or other legal process in lieu thereof), in the event of nonpayment or nonacceptance. In the absence of such specific instructions, the banks concerned with the collection have no obligation to have the document(s) protested (or subjected to other legal process in lieu thereof) for nonpayment or nonacceptance. Any charges and/or expenses incurred by banks in connection with such protest, or other legal process, will be for the account of the party from whom the collection instruction was received. 托收指示對當(dāng)發(fā)生不付款或不承兌時的有關(guān)拒絕證書應(yīng)有具體的指示(或代之以其他法律程序)?! . Other Provisions Article 22 Acceptance The presenting bank is responsible for seeing that the form of the acceptance of a bill of exchange appears to be plete and correct, but is not responsible for the genuineness of any signature or for the authority of any signatory to sign the acceptance. 提示行有責(zé)任注意匯票承兌形式看來是完整和正確的,但是,對任何簽字的真實性或簽署承兌的任何簽字人的權(quán)限不負責(zé)任?! . In all cases where in the express terms of a collection instruction or under these Rules, disbursements and/or expenses and/or collection charges are to be borne by the principal, the collecting bank(s) shall be entitled to recover promptly outlays in respect of disbursements, expenses and charges from the bank form which the collection instruction was received, and the remitting bank shall be entitled to recover promptly from the principal any amount so paid out by it, together with its own disbursements, expenses and charges, regardless of the fate of the collection. 在任何情況下,若托收指示中清楚地規(guī)定或根據(jù)本〈規(guī)則〉,支付款項和(或)費用和(或)托收手續(xù)費應(yīng)由委托人承擔(dān),代收行應(yīng)有權(quán)從向其發(fā)出托收指示的銀行立即收回所支出的有關(guān)支付款、費用和手續(xù)費,而寄單行不管該托收結(jié)果如何應(yīng)有權(quán)向委托人立即收回它所付出的任何金額連同它自己的支付款、費用和手續(xù)費?! . Where the collection instruction expressly states that charges and/or expenses may not be waived and the drawee refuses to pay such charges and/or expenses, the presenting bank will not deliver documents and will not be responsible for any consequence arising out of any delay in the delivery of the document(s). When payment of collection charges and/or expenses has been refused the presenting bank must inform by telemunication or, if that is not possible, by other expeditious means without delay the bank from which the collection instruction was received. 如果托收指示中明確指明手續(xù)費和(或)費用不得放棄而付款人又拒付該項費用時,提示行將不交單,并對由此所引起的延誤所產(chǎn)生的后果將不承擔(dān)責(zé)任?! rticle 21 Charges and Expenses手續(xù)費和費用 a. If the collection instruction specifies that collection charges and/or expenses are to be of account of the drawee and the drawee refuses to pay them, the presenting bank may deliver the document(s) against payment or acceptance or on other terms and conditions as the case may be, without collecting charges and/or expenses, unless subarticle 21 (b) applies.
