This paper introduced Marital property regime, pointed out that the major flaw in the system, as well as the corresponding points of legislative proposals. Key words:Marital Property System。從法律條文上放寬夫妻財產(chǎn)協(xié)議的締約時間，這也充分維護當事人的財產(chǎn)權(quán)益，尊重當 事人的意思自由，而且也符合社會實際和社會習慣的要求，擬結(jié)為夫妻的雙方當事人能夠明確的法律資格進行約定財產(chǎn)關(guān)系對于司法實踐具有重要意義。 [4]夫妻財產(chǎn)關(guān)系是一種時刻處于變化狀態(tài)的法律關(guān)系，因而夫妻財產(chǎn)協(xié)議自然會面對情勢變更問題。 某些國家是不允許既定的夫妻財產(chǎn)協(xié)議進行變更或者撤銷的。例如法國的民法典規(guī)定，夫妻在締結(jié)財產(chǎn)協(xié)議的過程中，應(yīng)該有公證 5 人在現(xiàn)場，夫妻雙方對協(xié)議的內(nèi)容都表示接受并由在場的公證人簽章。 我國現(xiàn)行的《婚姻法》只要求夫妻雙發(fā)以書面的形式訂立財產(chǎn)協(xié)議，而沒有規(guī)定任何公示程序和制度，使得
