淺析我國的夫妻約定財產(chǎn)制度畢業(yè)論文-閱讀頁

【正文】 的。筆者認(rèn)為，夫妻財產(chǎn)協(xié)議既然本質(zhì)上是一種契約，根據(jù)合同法原理自然應(yīng)該允許雙方當(dāng)事人在合意的情形下變更或撤銷，這也是意思自治原則的要求。 [4]夫妻財產(chǎn)關(guān)系是一種時刻處于變化狀態(tài)的法律關(guān)系，因而夫妻財產(chǎn)協(xié)議自然會面對情勢變更問題。 第六，對婚前財產(chǎn)約定賦予明確的法律效力。從法律條文上放寬夫妻財產(chǎn)協(xié)議的締約時間，這也充分維護當(dāng)事人的財產(chǎn)權(quán)益，尊重當(dāng) 事人的意思自由，而且也符合社會實際和社會習(xí)慣的要求，擬結(jié)為夫妻的雙方當(dāng)事人能夠明確的法律資格進行約定財產(chǎn)關(guān)系對于司法實踐具有重要意義。本文從我國現(xiàn)如今的夫妻約定財產(chǎn)制的不足之處出發(fā)，找出其相應(yīng)的解決辦法。 參考文獻 [1]蔣月主編 .婚姻家庭與繼承法 [M].廈門大學(xué)出版社 .2020 年 8 月第二版 .第 146147 頁 .
