. 就本節(jié)而言, the purpose of this section, 1) “ 基本報(bào)酬或工資 ” 一詞系指正常工作時(shí)間的報(bào)酬 , 無(wú)論這一報(bào)酬如何構(gòu)成 ; 它不包括加班報(bào)酬、獎(jiǎng)金、津貼、帶薪休假或任何其他額外酬勞; basic pay or wages means the pay, however posed, for normal hours of work。 it does not include payments for overtime worked, bonuses, allowances, paid leave or any other additional remuneration。 2) “ 合并工資 ” 一詞系指包括基本工資和與工資有關(guān)的其他津貼在內(nèi)的工資或薪資 ; 合并工資可包括對(duì)所有加班工作給予的補(bǔ)償和所有其他與工資相連的津貼,或者,它也可以包括部分合并工資內(nèi)的某些津貼; consolidated wage means a wage or salary which includes the basic pay and other payrelated benefits。 a consolidated wage may include pensation for all overtime hours which are worked and all other payrelated benefits, or it may include only certain benefits in a partial consolidation。 3) “ 工作時(shí)間 ” 一詞系指要求海員在船舶工作的時(shí)間。 15 hours of work means time during which seafarers are required to do work on account of the ship。 4) “ 加班 ” 一詞系指超出正常工作時(shí)間之外工作的時(shí)間。 overtime means time worked in excess of the normal hours of work. 海員在船工資計(jì)算: Calculating wages of seafarers on board: 1) 海員在船期間,以每日工作 8小時(shí)為依據(jù)施行綜合計(jì)算工時(shí)制。 On the basis of 8 hours a working day during seafarers on board, to implement the integrated putation manhour system. 2) 海員正常工作時(shí)間應(yīng)得的報(bào)酬包括基本工資和所有固定津貼。該項(xiàng)報(bào)酬不低于適用 的《中國(guó)船員集體協(xié)議》中規(guī)定的最低工資標(biāo)準(zhǔn)。 Remuneration for that portion of the fully or partially consolidated wage representing the normal hours of work should be no less than the applicable minimum wage in the Chinese seafarers collective agreement。 3) 海員在船工作期間 , 遇國(guó)家法定節(jié)假日 , 公司按其基本工資的 3倍支付額外薪資 。 Company should pay the additional salary by 3 times the basic wage for the national holidays for seafarers on board a ship. 海員在船工資計(jì)算: Calculating wages for seafarers working onboard a ship 1) 本公司海員薪酬構(gòu)成為: 基本工資、 加班工資和休假工資、崗位津貼(包括兼職工資和駕駛員的自引補(bǔ)貼等)、社保補(bǔ)貼、住房補(bǔ)貼和安全獎(jiǎng)等組成 。 Seafarers remuneration poses basic pay, payments for overtime worked, paid leave, post allowances (includes concurrent post pay and allowance for berthing operation by master and officers), allowance of social security, housing subsidy and safety bonuses. 2) 海員就業(yè)協(xié)議明確說(shuō)明海員為這一報(bào)酬而需工作的時(shí)間,并說(shuō)明除了合并工資外可能 應(yīng)支付的任何額外津貼以及在何種情況下支付; The seafarers’ employment agreement should specify clearly, the number of hours of work expected of the seafarer in return for this remuneration, and any additional allowances which might be due in addition to the consolidated wage, and in which circumstances。 3) 凡對(duì)超出合并工資所涵蓋的工作時(shí)間按每小時(shí)加班支付的,該小時(shí)報(bào)酬率不應(yīng)低于正常工時(shí)間對(duì)應(yīng)的基本工資率的 ;同樣的原則也適用于包括在合并工資內(nèi)的加班時(shí)間; Where hourly overtime is payable for hours worked in excess of those covered by the consolidated wage, the hourly rate should be not less than one and one quarter times the basic rate corresponding to the normal hours of work as defined in paragraph 1 of this Guideline。 the same principle should be applied to the overtime hours included in the consolidated wage。 4) 全部和部分合并工資中屬于正常工作時(shí)間的那一部分報(bào)酬不應(yīng)低于適用的最低工資; Remuneration for that portion of the fully or partially consolidated wage representing the normal hours of work should be no less than the applicable minimum wage。 and 工資支付 payment made 1) 公司每月將海員的工資通過(guò)銀行匯入海員本人指定的銀行賬戶 。 且公司不收取海員的 任何服務(wù)費(fèi) 。 The payment should be remitted to bank account nominated by seafarer. Company do not collect any charge for the service. 2) 公司向每個(gè)在船海員提供包括其應(yīng)得報(bào)酬、扣減項(xiàng)目和實(shí)付數(shù)額的工資和額外報(bào)酬的月薪賬目。 Seafarers shall be given a monthly account of the payments due and the amounts paid, including wages. 3) 月薪賬目中的貨幣單位為 人民 幣 。 16 The currency unit is RMB. 4) 有下列情況之一的 , 公司可以代扣海員的工資 : Any of the following circumstances, Company can withhold the seafarer39。s wages: ① 公司代扣代繳的個(gè)人所得稅; IIT withheld by Company。 ② 公司代扣代繳的應(yīng)由勞動(dòng)者個(gè)人負(fù)擔(dān)的各項(xiàng)社會(huì)保險(xiǎn)費(fèi)用; All social security charges withheld by Company, which should be borne by individual worker。 ③ 法院判決、裁定中要求代扣的撫養(yǎng)費(fèi)、贍養(yǎng)費(fèi); Cost of upbringing, alimony required to be withheld by judicial decision or ruling。 ④ 法律、法規(guī)規(guī)定可以海員工資中扣除的其他費(fèi)用。 Other charges which laws and regulations established that could be permitted deducted from seafarer’ s payment. 5) 只有在下列情況下 , 才允許在報(bào)酬中做出扣 減 。 Deduction from remuneration should be permitted only if: 1) 國(guó)家法律或條例或適用的集體協(xié)議有明確規(guī)定且已通過(guò)主管當(dāng)局認(rèn)為最合適的方式向海員通知了此種扣減的條件;以及 There is an express provision in national laws or regulations or in an applicable collective agreement and the seafarer has been informed, in the manner deemed most appropriate by the petent authority, of the conditions for such deductions。 and 2) 扣減總額不超過(guò)國(guó)家法律或條例或集體協(xié)議或法院裁決可能已為此種扣減規(guī)定的限制。 The deduction does not in total exceed the limit that may have been established by national laws or regulations or collective agreements or court decisions for making such deductions。 6) 除上述 4)外,禁止對(duì)海員進(jìn)行罰款。 Moary fines against seafarers other than the stipulations of abovementioned 4) should be prohibited。 公司承諾同工同酬適用于受雇于同一船舶的所有海員 , 不得依據(jù)種族 、 膚色 、 性別、 宗教信仰、政治觀點(diǎn)、民族血統(tǒng)或社會(huì)出身加以歧視 。 Company promises that equal remuneration for work of equal value should apply to all seafarers employed on the same ship without discrimination based upon race, colour, sex, religion, political opinion, national extraction or social origin. 工作及休息時(shí)間 Hours of work and hours of rest 海員在船工作期間 , 海員的正常工時(shí)標(biāo)準(zhǔn)應(yīng)以每天 8小時(shí) , 每周休息 2天和公共節(jié)假日休息為依據(jù) ,休息時(shí)間定義應(yīng)符合船旗國(guó)規(guī)定 。 然而 , 這并不妨礙成員國(guó)利用有關(guān)程序批準(zhǔn)或注冊(cè)在不低于這一標(biāo)準(zhǔn)的基礎(chǔ)上確定海員正常工時(shí)的集體協(xié)議。 The normal working hours’ standard for seafarers, like that for other workers, shall be based on an eighthour day with 2 days of rest per week and rest on public holidays. However, this shall not prevent the Member from having procedures to authorize or register a collective agreement which determines seafarers’ normal working hours on a basis no less favourable than this Standard. 安排海員工作或休息時(shí)間應(yīng)限制在: The limits on hours of work or rest shall be as follows: 17 ① 最長(zhǎng)工作時(shí)間: maximum hours of work shall not exceed: (i) 在任 何 24小時(shí)時(shí)段內(nèi)不得超過(guò) 14小時(shí);且 14 hours in any 24hour period。 and (ii) 在任 何 7天時(shí)間內(nèi)不得超過(guò) 72小時(shí); 72 hou
