【導(dǎo)讀】根據(jù)《中華人民共和國(guó)勞動(dòng)法》、《中華人民共和國(guó)勞動(dòng)合同法》等法律、法規(guī)、規(guī)章的規(guī)定，在平等自愿，協(xié)商一致的基礎(chǔ)上，同意訂立本勞動(dòng)合同，共同遵守本合同所列條款。一.勞動(dòng)合同類型及期限按下列第1項(xiàng)確定。三．乙方應(yīng)積極遵守公司所有規(guī)章制度，按質(zhì)、按量、按時(shí)完成其本職工作。乙方每日工作時(shí)間不超過(guò)8小時(shí)，每周工作時(shí)間不超過(guò)40小時(shí)，每周至少休。力或效力導(dǎo)致的加班屬于正常工作時(shí)間。如遇節(jié)假日則相應(yīng)順延。規(guī)及甲方依法制定的規(guī)章制度執(zhí)行。
【正文】 In case of unsuccessful negotiation, the contending party may apply for labor arbitration. 第 十三 條 雙方需要約定的其他事項(xiàng) Article 13 Other matters considered necessary by the Parties 一 . 甲方可根據(jù)工作需要及乙方的身體狀況、工作能力和表現(xiàn)根據(jù)甲方的規(guī)章制度升、 降乙方的職務(wù)，乙方愿意服從甲方的安排；入職前， 甲方已安排專職翻譯向乙方 詳細(xì)翻譯并解釋了甲方的《員工手冊(cè)》、《 薪酬管理制度 》 等規(guī)章制度， 乙方已熟知、理解、并同意自覺(jué)遵守甲方的相關(guān) 規(guī)章制度。 Where Party A is able to promote or demote Party B base on the needs of work, physical condition, ability and performance, which is according to the Company regulations. Party B is willing to accept Part A’s arrangement. Premencement, Party A have arranged fulltime translator to translate and explain the details of regulations and rules of 《 Employee Handbook》 and《 Remuneration Rule》 .Party B should familiar with, understand, and agree to abide to Party A’s relevant regulation and rules. 第十 四 條 其他 Article 14 Miscellaneous 一 . 本合同在履行中發(fā)生爭(zhēng)議，任何一方均可向企業(yè)勞動(dòng)爭(zhēng)議調(diào)解委員會(huì)申請(qǐng)調(diào)解，也可向勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁。對(duì)仲裁裁決不服的，可以向人民法院起訴。 If any dispute arises under this Contract, either Party may file an application for mediation with the enterprise labor dispute mediation mittee, or file an application for arbitration with the labor dispute arbitration mittee. If either party disagrees with the arbitration ruling, the party may file a proceeding in a People’s Court with petent jurisdiction. 二 . 本合同未盡事項(xiàng)，按國(guó)家有關(guān)法律法規(guī)執(zhí)行。 Matters that are not provided in this Contract will be dealt with in accordance with existing laws, rules and regulations. 三 . 本合同條款如與今后國(guó)家頒布的法律法規(guī)相抵觸時(shí)，按國(guó)家新的法律法規(guī)執(zhí)行。 Should any provision of this Contract be in violation of the PRC laws or regulations, the new laws and regulations shall govern. 四 . 本合同依法訂立，雙方簽字蓋章后生效， 涂改或未經(jīng)書(shū)面授權(quán)代簽無(wú)效， 雙方必須嚴(yán)格履行。 This Contract is entered into in accordance with the law and shall be effective upon execution by the Parties. Any alter or without written authorization is invalid. The Parties must strictly perform this Contract. 五 . 本合同一式兩份，甲乙雙方各執(zhí)一份。 This Contract is produced in two original copies.
