【文章內(nèi)容簡介】 扣和傭金、有關(guān)實(shí)際停租或估計(jì)停租期間的任何款項(xiàng)或費(fèi)用，還扣除租船人合理估算，在上述期間內(nèi)所發(fā)生的費(fèi)用以及根據(jù)本租約，租船人對(duì)船東的索賠款項(xiàng)，如付款到期之日，本船停租，則租金余額應(yīng)在本船起租后七個(gè)銀行營業(yè)日內(nèi)支付，租船人還有權(quán)在最后整月租金中扣除預(yù)計(jì)代船東墊 付的港口使用費(fèi)和開支以及還船時(shí)船上存油的估計(jì)金額，以上付款，還船后多退少補(bǔ)。 Payment of Hire : First payment of hire to be made within seven banking days of the Vessel39。s delivery and subsequent payments of hire within seven banking days of the due date， in cash， in to semimonthly in advance （ except for the last period， hire to be payable for such length of time as reasonably estimated by Charterers necessary to plete the last voyage） less， in addition to where specifically provided herein， mission and brokerage due to Charterers/ their Agents， any amount or expenses in respect of actual or estimated offhire periods， any expenses incurred by Charterers which may reasonably be estimated by them to relate to such offhire periods and any amount of claims Charterers may have on Owners under this Charter. If on due date the Vessel be off hire， the balance payment for the period to be made within seven banking days after the Vessel is again onhire. The Charterers also to have right to deduct from the last full month39。s hire the disbursements expected to be made on Owners39。 behalf of expenses expected to be incurred by charterers for Owners39。 account and estimated cost of bunkers remaining on board on redelivery， and when the Vessel is redelivered any overpayment to be refunded by Owners or underpayment paid by Charterers. 如未履行支付租金，船東有權(quán)撤船，不給租船人使用，但這并不損害船東根據(jù)本租約在其他方面對(duì)租船人具有的索賠權(quán)。 In default of payment the Owners may withdraw the Vessel from the service of Charterers， without prejudice to any claim Owners may otherwise have on Charterers under this Charter. 12．還船 本船應(yīng)于租約期滿時(shí)， ***交付給租船人時(shí)大體相同的良好狀態(tài)（自然損耗和由于第 21條列舉的原因所造成的船舶過失除外），在租船人選擇的安全、沒有冰凍的港口 退還。 The Vessel to be redelivered on the expiration of the Charter in the like good order as when delivered to the Charterers （ fair wear and tear and loss of or damage to the Vessel by reason stated in Clause 21 excepted） at a safe， icefree port in Charterers39。option in 租船人有卸畢還船的選擇權(quán)，給船東或水手支付包干費(fèi)最多 以代替清艙，清除墊料。 The Charterers to have the option of re delivering the Vessel upon pletion of discharge， paying Owners or Crew members a lumpsum of maximum in lieu of holding cleaning including dunnage removal. 還船通知 :租船人給船東不少于十天的預(yù)計(jì)還船港口和日期的通知。 Notice of Redelivery Last Voyage:The Charterers to give Owners not less than ten days39。 notice of Vessel39。s expected port and date of redelivery. 最后航次 :如本船被擋令的航次超過租期時(shí)，租船人可使用本船完成該航次，但如市價(jià)高于租約規(guī)定的租率，則對(duì)于超過租期的時(shí)間 ***市價(jià)支付。 Should the Vessel be ordered on a voyage by which the Charter period will be exceeded the Charterers to have the use of the Vessel to enable them to plete the voyage and pay the market rate for any time exceeding the termination date if market rate is higher thanthe rate stipulated herein. 13．貨位 Space 除 保留適當(dāng)足夠的部位供船長、船員、水手使用及存放船具、屬具、家具、食品與船用品外，本船所有空間和運(yùn)力，如有客艙，也包括在內(nèi)，均歸租船人使用。 The whole reach and burden of the Vessel including passenger acmodation， if any， to be at Charterers39。 disposal， reserving proper and sufficient space for the Vessel39。s Master， Officers， Crew， tackle， apparel， furniture，provisions and stores. 甲板貨 :租船人有權(quán) ***照通常海運(yùn)慣例，在甲板及／或艙口部位裝滿貨物，費(fèi)用自理，并承擔(dān)風(fēng)險(xiǎn)，裝載甲板貨應(yīng)受到船舶穩(wěn)性和適航性的限制，航行中，船長與水手對(duì)甲板貨應(yīng)妥善照料并拉緊捆索。 Deck Cargo:The Charterers to have the privilege of loading a full cargo on deck and/or on hatches in accordance with normal marine practice at their expense and risk and deck load will be controlled by Vessel39。s stability and seaworthiness. Whilst in navigation the Master to take good care for deck cargo and tighten up lashings on deck cargo with the Vessel39。s Crew. 14．租船人 39。 Representatives 租船人有權(quán)派代表一至二人。代表上船并押運(yùn)并 ***察航次盡快運(yùn)行 ***況，對(duì)他們將免費(fèi)提供房間并供應(yīng)與船長相同的伙食標(biāo)準(zhǔn)，費(fèi)用由租船人負(fù)擔(dān)。 The Charterers to have the privilege of putting one/two of their Representatives on board the Vessel， who shall acpany the Vessel and see that the voyages are prosecuted with utmost despatch. They are to be furnished with free acmodations and same fare as provided for the Master39。s table ， victualling expenses to be for Charterers39。 account. 15． ***件 船東保 ***持有并隨船攜帶必要的 ***件，以符合所掛港口的安全衛(wèi)生規(guī)定和當(dāng)前要求。 The Owners warrant to have secured and carry on board the necessary certificates to ply with Safety and Health Regulations and all current requirements in all ports of call. 船東保 ***，本船起貨機(jī)及其他一切設(shè)備符合本船靠 掛港口的規(guī)定，還保 ***本船隨時(shí)持有現(xiàn)行有效 ***件，在各方面符合這種規(guī)定，如船東未能照辦使其符合上述規(guī)定或未持有上述 ***件以致岸上人員不能作業(yè)，則由此損失的時(shí)間應(yīng)停租，由此產(chǎn)生的額外費(fèi)用由船東負(fù)擔(dān)。 The Owners guarantee that Vessel39。s cargo gear and all other equipment to ply with the regulations in all ports visited by the Vessel， and that the Vessel to be at all times in possession of valid and upto date certificates to ply with such regulations in every respect.
