【正文】 Party B. 第三條　甲方根據(jù)乙方的要求向乙方派遣員工，乙方須按照約定向甲方支付借用費。Article 1 For the purpose of this Contract, Dispatching means Party A dispatches its employee who has employment relation with itself to work for Party B. 第二條　借用系指乙方按照本合同約定，從甲方借調(diào)人員到乙方工作的行為。員工的工作地點、崗位、方式由乙方根據(jù)業(yè)務(wù)需要確定。The social insurance premiums and housing fund of the Employee. （三）甲方為派遣員工提供商業(yè)保險、福利的費用。 Working Contents 第二章 甲方的義務(wù)與權(quán)利CHAPTER TWO RIGHTS AND OBLIGATIONS OF PARTY A第七條　甲方承擔(dān)下列義務(wù)：Article 7 Party A shall assume the following obligations:　　（一）根據(jù)乙方的要求推薦人選，與乙方?jīng)Q定借用的人員或乙方直接選定的人員簽訂《派遣員工勞動合同》。to pay the Employee wages and other remunerations he deserves from the borrowing fees. （五）在乙方支付借用費后，依法承擔(dān)派遣員工的社會保險、住房公積金及福利費用，其中福利及醫(yī)療保險部分內(nèi)容的具體實施按照本合同及其附件條款、甲方有關(guān)派遣員工福利待遇、醫(yī)療費用報銷的規(guī)定執(zhí)行。補償費以派遣員工被撤回當(dāng)月的借用費為計算標(biāo)準(zhǔn)。Party A is entitled to terminate this contract at any time for no reason, and claim for pensation from Party B, if Party B fails to pay the dispatched employee39。否則，產(chǎn)生的后果由乙方自行承擔(dān)。為借用滿一年以上（含一年）的員工每年安排一次帶薪休假，具體休假天數(shù)按乙方的規(guī)定執(zhí)行。The contents stipulated in Clause (3), (4) and (5) contained in this Article, can be determined by Party B and embodied in its Rules and Regulations of the Company, or is formed by another agreement reached and signed between the dispatched Employee and Part B. Such Rules and Regulations of Party B or agreement shall prevail, as long as they do not violate any laws, decrees or regulations of the state, and, has been already sent to Party A for record. 第十條　乙方享有如下權(quán)利：Article 10 Party B shall have the following rights:?。ㄒ唬Q定借用的員工可以規(guī)定試用期，試用期限應(yīng)根據(jù)借用期限確定：may decide the probation period of the dispatched employee based on the borrowing period: 1．借用期在6個月以下的，試用期不超過15日；Where the borrowing period of the dispatched employee is less than six (6) months, the probation period may not exceed 15 days 2．借用期在6個月以上1年以下的，試用期不超過30日；Where the borrowing period of the dispatched employee is more than six (6) months but less than one year, the probation period may not exceed 30 days。試用期滿，所派遣員工自動轉(zhuǎn)為正式派遣員工，其借用期自試用之日起計算。補償費以派遣員工被退回甲方當(dāng)月的借用費為計算標(biāo)準(zhǔn)。May sign the individual agreement with the dispatched employee，and send one copy to Party A for record. However, such agreement shall not violate a mandatory provisions of any law, administrative regulation, or terms and conditions of this contract. ?。ㄎ澹┮曳接袡?quán)對甲方違反本合同有關(guān)條款的行為提出書面意見，并進行交涉。以上費用每逾期10天按1%加付滯付金。8小時實際加點時間150%；Overtime on working days: Monthly wage247。8小時實際加班時間200%；Overtime on holidays: Monthly wage 247。 8小時實際加班時間300%；Overtime on legal public holidays: Monthly wage 247。Article 14 Any disputes in connection with this Contract or the execution thereof shall be amicably settled through negotiations In case no settlement can be reached between the two Parties, it shall be submitted to the court which has the jurisdiction to file a litigation. 第十五條　甲方（或乙方）與派遣員工因本合同中有關(guān)勞動紀(jì)律約定、員工工資、保險等勞動權(quán)利和義務(wù)的內(nèi)容發(fā)生勞動爭議，并提起勞動爭議仲裁時，如爭議的處理結(jié)果與乙方（或甲方）有利害關(guān)系，乙方有參加仲裁活動的權(quán)利和義務(wù)。Article 18 In case that any new law, decree or regulation of the state is enacted, or there is any modification happens in the exercising statues, the parties may alter this Contract subject to the newly modified laws, decrees and regulations. 第十九條　本合同自____年____月____日起生效，合同期滿前一個月內(nèi)，如甲乙雙方均未提出異議，有效期自行延長，延長期限與本合同期限相同
