【正文】 15 days prior to the date of shipment, the Buyer shall inform the Seller by cable or telex of the contract number, name of vessel, ETA of vessel, quantity to be loaded and the name of shipping agent, so as to enable the Seller to contact the shipping agent direct and arrange the shipment of the goods. The Seller shall advise by cable or telex in time the Buyer of the result thereof. Should, for certain reasons, it bee necessary for the Buyer to replace the named vessel with another one, or should the named vessel arrive at the port of shipment earlier or later than the date of arrival as previously notified to the Seller, the Buyer or its shipping agent shall advise the Seller to this effect in due time. The Seller shall also keep in close contact with the agent or the Buyer. 貨物裝運(yùn)日前 10- 15 天,買方應(yīng)以電報(bào)或電傳通知賣方合同號(hào)、船只預(yù)計(jì)到港日期、裝運(yùn)數(shù)量及船運(yùn)代理人的名稱。賣方亦應(yīng)與買方的運(yùn)輸代理或買方保持密切聯(lián)系。上述費(fèi)用均憑原始單據(jù)經(jīng)買方核實(shí)后支付。未經(jīng)買方事先許可,不得轉(zhuǎn)船。買方不接受非保賠協(xié)會(huì)成員的船只。對(duì)超過(guò) 15 年船齡的船只其超船齡額外保險(xiǎn)費(fèi)應(yīng)由賣方負(fù)擔(dān)。 If goods are to be shipped per liner vessel under liner Bill of Lading, the carrying vessel must be classified as the highest ____________ or equivalent class as per the Institute Classification Clause and shall be so maintained throughout the duration of the relevant Bill of Lading. Nevertheless, the maximum age of the vessel shall not exceed 20 years at the date of loading. The seller shall bear the average insurance premium for liner vessel older than 20 years. However in such a case, the Seller shall immediately advise by cable or telex the Buyer of the accident and airmail to the Buyer within 15 days after the accident, a certificate of the accident issued by the petent government authority or the chamber of merce which is located at the place where the accident occurs as evidence thereof. If the said “Force Majeure” cause lasts over 60 days, the Buyer shall have the right to cancel the whole or the undelivered part of the order for the goods as stipulated in Contract. 23. 人力不可抗 由于一般公認(rèn)的 “人力不可抗拒 ”原因而不能 交貨或延遲交貨,賣方或買方都不負(fù)責(zé)任。在爭(zhēng)議發(fā)生之日起一個(gè)合理的時(shí)間內(nèi),最多不超過(guò) 90 天,協(xié)商不能取得對(duì)買賣雙方都滿意的結(jié)果時(shí),如買方?jīng)Q定不向他認(rèn)為合適 的有管轄權(quán)的法院提出訴訟,則該爭(zhēng)議應(yīng)
