【正文】 f the People’s Republic of China on Protection of Consumer Rights and Interests(Adopted at the Fourth Meeting of the Standing Committtee of the Eighth National People’s Congress on October 31, 1993, and shall enter into force as of January 1, 1994.)*注:本篇法規(guī)已被《》(發(fā)布日期:2009年8月27日 實(shí)施日期:2009年8月27日)修改中華人民共和國(guó)主席令 ( 第十一號(hào))(相關(guān)資料:) Article 4 In transactions between business operators and consumers a principle of voluntariness,equality, fairness, honesty and credibility shall be followed.  第四條 經(jīng)營(yíng)者與消費(fèi)者進(jìn)行交易,應(yīng)當(dāng)遵循自愿、平等、公平、誠(chéng)實(shí)信用的原則?! ?guó)家采取措施,保障消費(fèi)者依法行使權(quán)利,維護(hù)消費(fèi)者的合法權(quán)益?! ?guó)家鼓勵(lì)、支持一切組織和個(gè)人對(duì)損害消費(fèi)者合法權(quán)益的行為進(jìn)行社會(huì)監(jiān)督。)Chapter II Rights of Consumers第二章 消費(fèi)者的權(quán)利Article 7 Consumers shall, in their purchasing and using modities or receiving services, enjoy the right of the inviolability of their personal and property safety.  Consumers shall have the right to demand business operators to supply modities and services up to the requirements of personal and property safety.  第七條 消費(fèi)者在購(gòu)買、使用商品和接受服務(wù)時(shí)享有人身、財(cái)產(chǎn)安全不受損害的權(quán)利。(相關(guān)資料:) Article 9 Consumers shall enjoy the right of free choice of modities or services.  Consumers shall have the right to make a free choice of business operators for supply of modities or services, select freely among varieties of articles or forms of services and decide independently to buy or not to buy any kind of modities, or to accept or not to accept any item of services.  Consumers shall have the right to make parisons, differentiations and selections when they make a free choice of modities or services.  第九條 消費(fèi)者享有自主選擇商品或者服務(wù)的權(quán)利。(相關(guān)資料:) Article 11 Consumers suffering from personal injury or property damage resulting from their purchasing or using of modities or receiving of services shall have the right to demand pensations in accordance with the law.  第十一條 消費(fèi)者因購(gòu)買、使用商品或者接受服務(wù)受到人身、財(cái)產(chǎn)損害的,享有依法獲得賠償?shù)臋?quán)利。) Article 13 Consumers shall have the right to acquire knowledge concerning consumption and protection of consumer rights and interests.  Consumers shall make efforts to master the knowledge of their necessary modities or services and the skill in operation thereof, apply the modities in a correct way and raise their consciousness of selfprotection.  第十三條 消費(fèi)者享有獲得有關(guān)消費(fèi)和消費(fèi)者權(quán)益保護(hù)方面的知識(shí)的權(quán)利。(相關(guān)資料:(相關(guān)資料:  經(jīng)營(yíng)者和消費(fèi)者有約定的,應(yīng)當(dāng)按照約定履行義務(wù),但雙方的約定不得違背法律、法規(guī)的規(guī)定。(相關(guān)資料:  經(jīng)營(yíng)者發(fā)現(xiàn)其提供的商品或者服務(wù)存在嚴(yán)重缺陷,即使正確使用商品或者接受服務(wù)仍然可能對(duì)人身、財(cái)產(chǎn)安全造成危害的,應(yīng)當(dāng)立即向有關(guān)行政部門報(bào)告和告知消費(fèi)者,并采取防止危害發(fā)生的措施。) Article 19 Business operators shall provide consumers with authentic information concerning their modities or services, and may not make any false and misleading propaganda.  Business operators shall give truthful and definite replies to inquiries from consumers about the qualities of the modities or services they supply and the operation methods thereof.  Shops shall mark clearly the prices of the modities they supply.  第十九條 經(jīng)營(yíng)者應(yīng)當(dāng)向消費(fèi)者提供有關(guān)商品或者服務(wù)的真實(shí)信息,不得作引人誤解的虛假宣傳。(相關(guān)資料:(相關(guān)資料:(相關(guān)資料:(相關(guān)資料:(相關(guān)資料:) Article 27 People’s governments at various levels shall strengthen their leadership, and organize,coordinate and supervise the administrative departments concerned to do their work well in the protection of the legitimate rights and interests of consumers.  People’s governments at various levels shall strengthen supervision to prevent occurrence of acts damaging to the personal or property safety of consumers and promptly check any such acts.  第二十七條 各級(jí)人民政府應(yīng)當(dāng)加強(qiáng)領(lǐng)導(dǎo),組織、協(xié)調(diào)、督促有關(guān)行政部門做好保護(hù)消費(fèi)者合法權(quán)益的工作。(相關(guān)資料:(相關(guān)資料:(相關(guān)資料:(4) to accept and hear plaints of consumers and offer investigations and mediations with respect to points of plaints?! 「骷?jí)人民政府對(duì)消費(fèi)者協(xié)會(huì)履行職能應(yīng)當(dāng)予以支持。) Article 33 Consumer organizations may not be engaged in modity transactions or profitmaking services, and may not remend to the society modities or services for the purpose of making profits.  第三十三條 消費(fèi)者組織不得從事商品經(jīng)營(yíng)和營(yíng)利性服務(wù),不得以牟利為目的向社會(huì)推薦商品和服務(wù)。(4) to apply to arbitral organs for arbitration according to the arbitral agreements with business operators。銷售者賠償后,屬于生產(chǎn)者的責(zé)任或者屬于向銷售者提供商品的其他銷售者的責(zé)任的,銷售者有權(quán)向生產(chǎn)者或者其他銷售者追償?! ∠M(fèi)者在接受服務(wù)時(shí),其合法權(quán)益受到損害的,可以向服務(wù)者要求賠償。) Article 37 In case a business operator unlawfully uses another’s business license to supply modities or services and infringes upon the legitimate rights and interests of consumers, the consumers may demand pensations either from such business operator or from the holder of the business licence.  第三十七條 使用他人營(yíng)業(yè)執(zhí)照的違法經(jīng)營(yíng)者提供商品或者服務(wù),損害消費(fèi)者合法權(quán)益的,消費(fèi)者可以向其要求賠償,也可以向營(yíng)業(yè)執(zhí)照的持有人要求賠償。展銷會(huì)結(jié)束或者柜臺(tái)租賃期滿后,也可以向展銷會(huì)的舉辦者、柜臺(tái)的出租者要求賠償。廣告的經(jīng)營(yíng)者不得提供經(jīng)營(yíng)者的真實(shí)名稱、地址的,應(yīng)當(dāng)承擔(dān)賠償責(zé)任。(4) not conforming to the quality indicated by the product description or by physical samples。(8) deliberately delaying or unreasonably refusing consumers’ requests for repair, remanufacture,replacement, return of goods, makeup for the short modity, return of payment for goods or services, or pensation for losses。) Article 41 Business operators shall, if the modities or services they supply have caused personal injuries to consumers or other victims, pay for the victims’ medical expenses, nursing expenses during medical treatment, the reduced ine for loss of working time and other expenses. And business operators shall, if the modities or services they supply have disabled the consumers,also pay for the victims’ expenses on selfhelp devices, living allowances, pensations for disability and the necessary living cost of the persons supported by the disabled. Business operators shall, if the case constitutes a crime, be investigated for criminal responsibility according to law.  第四十一條 經(jīng)營(yíng)者提供商品或者服務(wù),造成消費(fèi)者或者其他受害人人身傷害的,應(yīng)當(dāng)支付醫(yī)療費(fèi)、治療期間的護(hù)理費(fèi)、因誤工減少的收入等費(fèi)用,造成殘疾的,還應(yīng)當(dāng)支付殘疾者生活自助具費(fèi)、生活補(bǔ)助費(fèi)、殘疾賠償金以及由其扶養(yǎng)的人所必需的生活費(fèi)等費(fèi)用;構(gòu)成犯罪的,依法追究刑事責(zé)任。(相關(guān)資料:  對(duì)包修、包換、包退的大件商品,消費(fèi)者要求經(jīng)營(yíng)者修理、更換、退貨的,經(jīng)營(yíng)者應(yīng)當(dāng)承擔(dān)運(yùn)輸?shù)群侠碣M(fèi)用。) Article 46 Business operators who supply modities by mailorder shall provide their modities according to the agreements.
