【正文】 he WTO Agreement shows that the signatories to that Agreement were, in 1994, fully aware of the importance and legitimacy of environmental protection as a goal of national and i nt e r na t io na l p o l ic y. The p r e a m b le of t he WTO Agreement which informs not only the GATT 1994, but also the other covered agreements explicitly acknowledges the objective of sustainable development As this preambular language reflects the intentions of negotiators of the WTO Agreement, we believe it must add colour, texture and shading to our interpretation of the agreements annexed to the WTO Agreement, in this case, the GATT 1994. （ WT/DS58/AB/R ） 特殊意義 “多余的條款”？ 特定語境中的“通常意義” 對各要素的綜合把握 各要素之間的邏輯順序非等級順序 委員會在該條的標(biāo)題 “ 解釋通則 ” 中使用了 單數(shù) 形式 ， 強(qiáng)調(diào)了第 1段和第 2段之間以及第 3段和前兩段之間的關(guān)系 ，意圖表明該條規(guī)定中的各解釋方法的適用是一個綜合的運(yùn)作過程 。 應(yīng) 與上下文一并考慮者 尚有： （ a） 當(dāng)事國嗣后所訂關(guān)于條約之解釋或其規(guī)定之適用之任何協(xié)定； （ b） 嗣后在條約適用方面確定各當(dāng)事國對條約解釋之協(xié)定之任何慣例； （ c） 適用于當(dāng)事國間關(guān)系之任何有關(guān)國際法規(guī)則 。 各成員認(rèn)識到該體制適于保護(hù)各成員在所涉相關(guān)協(xié)定項下的權(quán)利和義務(wù) ，及 依照國際公法上的解釋習(xí)慣規(guī)則 （ customary rules of interpretation of public international law）澄清這些協(xié)定的現(xiàn)有規(guī)定 。 DSB的建議和裁決不能增加或減少所涉相關(guān)協(xié)定所規(guī)定的權(quán)利和義務(wù) 。
