【正文】 摘 要 在建設(shè) 工程 項(xiàng)目 合同 管理中,建設(shè) 工程 項(xiàng)目施工合同貫穿于建設(shè)工程項(xiàng)目實(shí)施的全過程,確定了工程的工期、成本及質(zhì)量這三大目標(biāo),對整個(gè)建設(shè)工程合同體系中的其他合同(如勘察設(shè)計(jì)合同、供應(yīng)合同等)有很大影響,在整個(gè)建設(shè)工程合同體系中處于主導(dǎo)地位。因此,在建設(shè) 工程 項(xiàng)目管理中加強(qiáng)對 項(xiàng)目 施工合同的管理具有十分重要的意義。 隨著我國市場經(jīng)濟(jì)體制的發(fā)展,建筑市場也隨之不斷發(fā)育成熟,以事實(shí)為依據(jù),按合同說話逐漸成為了建筑市場中的主流。但不可否認(rèn)的是,我國市場經(jīng)濟(jì)還 不夠成熟,長期以來人際關(guān)系、人情觀念 及領(lǐng)導(dǎo)指示等因素 代替了 合同條款,合同的權(quán)威性無從體現(xiàn)。 大量的工程實(shí)踐告訴我們,脫離了施工合同約束的工程是無法實(shí)現(xiàn)工程項(xiàng)目的目標(biāo)的, 因此,我們必須重視合同及合同管理,加強(qiáng)建設(shè)工程 項(xiàng)目 施工合同的規(guī)范管理,在實(shí)踐中逐步完善合同管理制度。 本論文站在業(yè)主的角度,對建設(shè)工程項(xiàng)目的施工合同管理進(jìn)行分析研究。首先介紹了合同管理在建設(shè)工程項(xiàng)目管理中的地位和作用,以及建設(shè)工程項(xiàng)目施工合同與其他建設(shè)工程合同的聯(lián)系,然后闡述了施工合同管理的基本概念、方法和內(nèi)容;最后對施工合同管理的現(xiàn)狀、存在的 問題以及未來發(fā) 展趨勢等基本問題進(jìn)行了探討,并提出了加強(qiáng)施工合同管理的幾點(diǎn) 措施。 關(guān)鍵詞: 建設(shè)工程項(xiàng)目管理,施工合同,合同管理 Abstract In the construction project contract management, construction contracts for construction projects run through the entire process in the implementation of construction projects, It confirms the construction period, cost and quality, the three target of engineering.
