【正文】 工程造價管理中索賠的探討摘要我國加入WTO后，建筑市場與國際市場接軌的程度越來越高，但目前國內(nèi)的承包商在一些涉外工程中常常遭遇國外的業(yè)主、承包商的大量索賠，主要原因之一就是索賠管理落后。因此本文從承包商的角度進行國際工程造價管理中索賠管理的探討，有助于承包商了解索賠，精于索賠。承包商進行索賠分析、管理，并提出有效的索賠要求，主要是為了獲得索賠補償，保護自身的權(quán)益。索賠作為工程實施中的重要環(huán)節(jié)，其成敗與否直接關(guān)系到承包商經(jīng)營的成敗得失，因此本文的研究對于我國承包商在國際工程項目索賠實踐中取得成功具有重要意義。本文首先對國內(nèi)外當前的工程施工索賠狀況進行了深入的分析，歸納總結(jié)了索賠現(xiàn)狀、特點及發(fā)展趨勢；其次在現(xiàn)狀分析基礎(chǔ)上分析了國際工程項目的不確定性問題及其影響因素，最后有針對性地提出了較系統(tǒng)全面的索賠管理建議，對承包商的國際工程項目索賠管理有一定的指導(dǎo)意義。關(guān)鍵詞：國際工程；施工索賠；索賠管理11AbstractThe construction market is catching up with the international market gradually after China39。s accession to the WTO , but at present domestic contractor in some foreign engineering often encounter large scale claims from foreign owners and contractors ,due in part to claims management is too far behind. Therefore this paper explores claims management from the view of the contractors in international engineering cost management, which helps contractors to understand and master claims. In order to obtain claim pensation and protect their rights and interests, the contractor devotes to analysis, management, and puts forward effective claims. Claim as an important link in the project implementation, the success or failure is directly related to the success or failure of the gain and loss, contractor management of this paper to research for our country’s contractor claim success in the international project in practice has important significance.This article begins with the deep analysis about domestic and foreign current situation of engineering construction counterclaim, and summarizes the status quo, characters and development trend of the claim. Moreover, it analyzes the uncertainty of international project problems and its influence factor on the base of the status.
