【正文】 碩士學(xué)位論文 論我國(guó)鐵路法規(guī)體系的完善 —— 以高鐵立法為契機(jī) 學(xué) 科 專(zhuān) 業(yè) 憲法學(xué)與行政法學(xué) 學(xué) 位 類(lèi) 型 □ √ 科學(xué)學(xué)位 □ 專(zhuān)業(yè)學(xué)位 研 究 生 姓 名 王 潔 導(dǎo)師姓名、職稱(chēng) 肖軍 副教授 論 文 編 號(hào) 湖南師范大學(xué)學(xué)位評(píng)定委員會(huì)辦公室 二 ○ 一 二 年五 月 分 類(lèi) 號(hào) 密級(jí) 學(xué)校代碼 10542 學(xué)號(hào) 202120211191 論我國(guó)鐵路法規(guī)體系的完善 —— 以高鐵立法為契機(jī) On the perfection of the railway regulatory system in our country —— as an opportunity of Highspeed railway legislation 研 究 生 姓 名 王 潔 教師 姓名、職稱(chēng) 肖軍 副教授 學(xué) 科 專(zhuān) 業(yè) 憲法 學(xué) 與行政法 學(xué) 研 究 方 向 憲法 與行政法治 湖南師范大學(xué)學(xué)位評(píng)定委員會(huì)辦公室 二 ○ 一二年五 月 I 摘 要 我國(guó) 現(xiàn)有鐵路法規(guī)體系存在問(wèn)題， 一方面 對(duì)鐵路主管部門(mén)和鐵路運(yùn)輸企業(yè)的 有關(guān)權(quán)責(zé) 規(guī)定 不明，另一方面 對(duì) 鐵路建設(shè)投資者、 鐵路 旅客 以及其他利害關(guān)系 主體 的 權(quán)益保障 規(guī)定 不足 。 高速鐵路的發(fā)展離不開(kāi)法律制度的支持 ， 當(dāng)前 政企職權(quán)不分， 相關(guān)主體權(quán)益保障不足的法規(guī)體系將阻礙高速鐵路事業(yè)發(fā)展， 當(dāng)務(wù)之急 是 完善鐵路法規(guī)體系 ，為我國(guó)鐵路行業(yè)發(fā)展保駕護(hù)航 。 文章第一部分 是 對(duì)我國(guó)鐵路法規(guī)體系 的 一般分析 。 簡(jiǎn)單介紹了我國(guó)現(xiàn)行的鐵路法規(guī)體系的 內(nèi)容及 構(gòu)成 ， 指出 其有關(guān) 建設(shè)規(guī)范 、運(yùn)輸安全規(guī)范 以及服務(wù)質(zhì)量規(guī)范方面 存在的 問(wèn)題，并 分析 所存問(wèn)題 的原因主要是《鐵路法》的 宗旨陳舊和鐵路系統(tǒng)政企不分。 文章第二部分是對(duì)我國(guó)高速鐵路法的特別分析 。 本部分介紹了高速鐵路的現(xiàn)狀和問(wèn)題， 提出 在建設(shè)、安全、服務(wù)方面進(jìn)行高速鐵路立法的必要性， 并 在此基礎(chǔ)上設(shè)想了高速鐵路規(guī)劃法、高速鐵路促進(jìn)法、高速鐵路安全法、高速鐵路服務(wù)法的立法內(nèi)容。 文章的第三部分是鐵路法規(guī)體系完善的路徑。 在 結(jié)合上文 并 參考我國(guó)有關(guān)民航和電信立法以及其他國(guó)家和地區(qū)的鐵路法律的基礎(chǔ)上，提出如下路徑： 在 法律層面修改《鐵路法》的宗旨，增加鐵路類(lèi)型將高速鐵路進(jìn)入鐵路法調(diào)整范圍， 明確 鐵路主管部門(mén) 職權(quán) 以區(qū)分政府和企業(yè)職責(zé)，增加有關(guān)鐵路的 建設(shè)、安全和服務(wù)方面內(nèi)容；在行政法規(guī)層面 ， 盡快出臺(tái)《鐵路建設(shè)管理?xiàng)l例》，并補(bǔ)充其有關(guān)高速鐵路規(guī)劃與融資 規(guī)定，修訂《鐵路安全管理?xiàng)l例》增加驗(yàn)證認(rèn)證 、 檢測(cè) 及監(jiān)督規(guī)定，修訂《鐵路交通事故應(yīng)急救援和調(diào)查處理?xiàng)l例》明確事故處理原則、事故責(zé)任、賠償限額，制定《高速鐵路服務(wù)規(guī)范》明確鐵路主 II 管部門(mén)及鐵路運(yùn)輸企業(yè)職責(zé)以及建立評(píng)價(jià)認(rèn)證制度與監(jiān)督制度；在部門(mén)規(guī)章和其他規(guī)范性文件層面，根據(jù)修改 后的《鐵路法》以及相關(guān)行政法規(guī)，進(jìn)行細(xì)化新規(guī)定的相關(guān)內(nèi)容以及 修改與法律法規(guī)抵觸的內(nèi)容等相關(guān)工作。 關(guān)鍵詞 ： 鐵路 法 ， 高速鐵路， 服務(wù)規(guī)范，法規(guī) 體系 III ABSTRACT There are problems on the existing railway regulatory system, on the one hand, the powers and responsibilities between the railway authorities and the railway transport enterprise is unknown, on the other hand, the rights of the railway construction investors, the passengers and the subject who has relevant interest is inadequate. Highspeed rail development is inseparable from the support of the legal system, the regulatory system which is regardless of the current government and enterprises powers, relevant subjects of interest to protect the inadequate will hinder the development of highspeed rail, It is imperative to improve the rail regulatory system for the development of China39。s railway industry. The first part is a general analysis of China39。s Railway regulation system. Give a brief introduction to the position of the contents of the rail regulatory system in China, and pointed out that its problems on the construction specifications, transportation safety norms and quality of service specification, And analysis of the cause of the problem are the obsolete purpose of the Railway Act and the railway system between government and enterprises none at all. The second part is a special analysis of the Highspeed Rail Legislation. This section describes the status and problems of the Highspeed rail, and put forward the need for IV the highspeed rail legislation in the construction, security, service ,at last, envisage the content of Highspeed rail planning Legislation, Highspeed rail promotion Legislation. Highspeed railway safety Legislation, Highspeed railway service Legislation. The third part is the path of the rail regulatory system is perfect. On the basis of the civil aviation act and the telemunication legislation in China, as well as railway law of other countries and regions, which made the following path: First of all modify the purpose of the Railway Act. Second to increase the rail type which enable highspeed rail into the adjustment range of the Railway Law. Thirdly,made responsibilities clearly between the railway authorities and the railway transport enterprise. Fourthly, increase the content of construction, safety and service in the Railway Law. Fifthly, introduce the Railway Construction management Ordinance as soon as possible, and amend the Railway Safety management Regulations and the Railway traffic accident emergency rescue and investigation and handling of Ordinance, the development of highspeed rail service specification. Seventhly according to the new Railway Act and the relevant administrative regulations, and refine to the requirement, and modify the content which is conflict with the laws and regulations.
