Party B shall not start the vehicle in the loading and unloading area until it gets instruction from Party A in order to protect personnel and goods safety. Any damage caused by Party B before Party B’s trailer placing to Party A’s receiving or shipping dock, Party B shall remain liable to pay damages for such goods at the retail prices of such goods showed at the stores (including WalMart Supercenter, Neighborhood Market, Sam’s Club and Trustmart Store) of Party A’s affiliates at the time when the loss or damage happens. Nevertheless, such reporting and handling pursuant to the instructions of Party A shall not relieve Party B of any obligations and liabilities, which it shall bear under the provisions of this Contract. If Party A suffers any losses due to the goods’ failure to arrive on prescribed time, such losses shall be borne by Party B. If Party B’s late to store arrival time exceeds 24 hours, Party B shall be liable to pay to Party A for such lost or damaged goods at the retail prices of such goods at the time when the loss or damage happens. If a consignment note provides for multiple shipments, Party A may terminate the whole consignment note before the first shipment of the goods or may terminate any shipment under the consignment note before the relevant shipment takes place and under such circumstances, Party A shall have no liability and Party B shall cancel the relevant transportation charges.
