上必須按照實(shí)際損失金額由乙方向甲方承擔(dān)損害賠償責(zé)任,數(shù)目重大者甲方有權(quán)追究其法律責(zé)任。 第十七條 若本合同條款與國(guó)家新規(guī)定及甲方新規(guī)章制度相抵觸,乙方同意服 從國(guó)家新規(guī)定和甲 方新規(guī)章制度。乙方應(yīng)當(dāng)認(rèn)真履行自己的勞動(dòng)職責(zé),并親自完成本合同約定的工作任務(wù)。 八 、勞動(dòng)合同的解除、終止和續(xù)訂 第二十條 經(jīng)甲、乙雙方當(dāng)事人協(xié)商一致,本合同可以解除。 第二 十一條 乙方有下列情形之一的,甲方可以隨時(shí)解除本合同: 嚴(yán)重違反勞動(dòng)紀(jì)律和規(guī)章制度的; 嚴(yán)重失職,營(yíng)私舞弊,給甲方造成重大損失的; 乙方?jīng)]有經(jīng)過(guò)甲方同意,同時(shí)與其他用人單位建立勞動(dòng)關(guān)系,對(duì)完成甲方的工作任務(wù)造成嚴(yán)重影響,或者經(jīng)甲方提出,拒不改正的; 因勞動(dòng)合同期滿致使本合同無(wú)效的; 依法被追究刑事責(zé)任或勞動(dòng)教養(yǎng)的; 乙方利用職務(wù)之便收受賄賂的或泄漏公司機(jī)密造成公司損失的。 在試用期內(nèi)的; 甲方 以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫勞動(dòng)的; 甲方 未按照勞動(dòng)合同約定支付勞動(dòng)報(bào)酬或者提供勞動(dòng)條件的。 第二十四條 乙方有下列情形之一的,甲方不得按本合同第二十四條的約定與乙方解除勞動(dòng)和同: 在甲方工作期間患職業(yè)病或者因工負(fù)傷并被確認(rèn)喪失或者部分喪失勞動(dòng)能力的; 患病或因工負(fù)傷,在規(guī)定的醫(yī)療期間的; 女職工在孕期、產(chǎn)期、哺乳期的; 法律、行政法規(guī)規(guī)定的其他情形。 九 、賠償責(zé)任 、違約責(zé)任 第二十六條 乙方未能提前書(shū)面提出解除勞動(dòng)合同的賠償金:未按照《勞動(dòng)合同法》提前三十日書(shū) 面形式通知甲方解除勞動(dòng)合同,需按照乙方日工資的標(biāo)準(zhǔn)來(lái)補(bǔ)足時(shí)間的賠償。 第 二十八 條 甲方根據(jù)乙方的要求出資為乙方辦理了外省市專業(yè)技術(shù)人員、管理人員的調(diào)動(dòng)引進(jìn) 手續(xù),在入戶手續(xù)完畢后,必須在本公司服務(wù)期滿 年。若在服務(wù)期內(nèi)自行離開(kāi)公司或違紀(jì)被甲方解除合同的,按 元人民幣的賠償額,根據(jù)乙方未服務(wù)滿的年限,按 比例折算( 年平均賠償金額 ) 賠償。 第 三十條 乙方不得在任何情況下將甲方的保密資料直接或者間接泄露給任何外人,如經(jīng)甲方發(fā) 現(xiàn)按甲方損失大小賠償。 第三十二條 甲乙雙方協(xié)商不成,可由爭(zhēng)議的一方申請(qǐng)勞動(dòng)仲裁。 第三十四條 從本合同簽訂生效之日起,原合同即日廢止。兩份合同具 同等法律效力。s Republic of China, Labor Contract Law of the People’s Republic of China, and Regulations of Shanghai Municipality on Labor Contract, in the principles of fairness, legitimacy, equality, voluntariness, consensus through negotiation and good faith. 1.
