論勞動合同中的違約金制度-展示頁

【正文】 雙方當(dāng)事人隨意約定違約金的情況。制定于十多年前《勞動法》已經(jīng)嚴(yán)重滯后于現(xiàn)實(shí)需要,一些條款如勞動合同的試用期、合同期限以及違約責(zé)任等規(guī)定已經(jīng)出現(xiàn)了嚴(yán)重的漏洞。隨著經(jīng)濟(jì)體制的改革的深化,1995年實(shí)施的《中華人民共和國勞動法》第一次以法律形式確立了我國勞動合同制度,適用了社會主義市場經(jīng)濟(jì)體制的要求,促進(jìn)了生產(chǎn)力的發(fā)展。一、《勞動合同法》違約金條款的出臺背景我國的勞動合同制度始于20世紀(jì)八十年代中期,1986年國務(wù)院發(fā)布的《國營企業(yè)實(shí)行勞動合同制度暫行規(guī)定》第一次以勞動法規(guī)的形式對中國實(shí)行勞動合同制度這一做法加以肯定。在這種趨勢之下,關(guān)于違約金條款的規(guī)定應(yīng)然誕生:《勞動合同法》第二十五條明確規(guī)定了只有在因?qū)m?xiàng)培訓(xùn)約定服務(wù)期的和因商業(yè)機(jī)密約定競業(yè)限制的這兩種情況下可以約定違約金。但在2008年1月1日《中華人民共和國勞動合同法》(以下簡稱《勞動合同法》)出臺之前,我國勞動合同的違約金問題一直處于一種法律上空白的狀態(tài),相關(guān)勞動立法并未明文涉及,而實(shí)務(wù)中違約金幾乎是勞動合同中的一項(xiàng)必備條款。 5關(guān)于約定服務(wù)期的前提——專項(xiàng)培訓(xùn) 6關(guān)于約定服務(wù)期的期限問題 8關(guān)于服務(wù)期的違約責(zé)任 9(二)、在競業(yè)限制約定中約定違約金。但新法在一些細(xì)節(jié)問題上尚未明確,又無可借鑒的判例,導(dǎo)致在具體個案中的適用存在一些爭議,往往依賴于法官的自由裁量,亟待相關(guān)司法解釋和地方性法規(guī)進(jìn)行完善。從提出到實(shí)施歷時三年之久的《勞動合同法》,關(guān)于其立法宗旨等問題從草案(一審)到四次審議中一直飽受爭議,直至今年一月才正式實(shí)施。編號:時間:2021年x月x日書山有路勤為徑,學(xué)海無涯苦作舟頁碼:第16頁 共16頁內(nèi)容提要一直以來,在我國勞動合同實(shí)踐中, 違約金的設(shè)定和支付是一個爭議較大的問題, 主要由于我國《勞動法》沒有對這一問題作出明確規(guī)定。 而用人單位往往利用這一法律漏洞,設(shè)定高額違約金以限制勞動者的擇業(yè)自由,從而引發(fā)了諸多不和諧的勞動爭議案件。新法以保護(hù)勞動者合法權(quán)益、促進(jìn)和諧穩(wěn)定勞動關(guān)系為宗旨, 明確規(guī)定了勞動合同只有在因?qū)m?xiàng)培訓(xùn)約定服務(wù)期的和因商業(yè)機(jī)密約定競業(yè)限制的這兩種情況下可以約定違約金,在防止用人單位濫用違約金條款、保護(hù)勞動者自主擇業(yè)權(quán)等方面起到重要作用。關(guān)鍵詞:違約 服務(wù)期 競業(yè)限制 傾斜保護(hù)Abstract: Since there’s no provision about the stipulation and payment of the default penalty in our country’s Labor law , it always causes dispute in the implementation of labor contracts. The employer often makes use of this legislation leak to stipulate high quota penalty ,which can limit the employees’ freedom to choose job .This phenomena is one important reason for the huge sum of labor dispute lasted three years from the statement of Labor Contract Law to its validity because of the controversy about its legislative objective and other dispute which existed from the first trial to last trial of this law . Ultimately , Labor Contract Law officially implements from January of this year .Its aim is to protect the employees’ legitimate rights and interests and to safeguard the harmonious labor relations .This law set that the default penalty can be stipulated in the labor contract because of the special training which stipulates a service term and the petition restriction for the mercial secret. Therefor , it plays an influential role to prevent the employers to abuse the penalty provision and to protect the employees’ freedom to choose because the new law’s provisions are not very clear on some details and there’s no legal precedent to refer, there are still a lot of disputes in concrete cases .
