【正文】 yer shall bear the expenses for receiving foreign expert in charge of the engineering to the Designer39。 if it exceeds the prescribed time limit over fifteen (15) days when the employer delivers above materials and documents, the designer is entitled to decide again the time of delivery of design documents. When the employer alters entrusted design items, scale and conditions, or delivers the wrong materials, or delivers mostly revised materials so that the designer rework for the design, the employer shall pay for rework cost for the designer based on the amount of the work performed by the designer except the supplemental agreement (or contract ) signed separately, and the relevant articles 11 specified again by both parties through the consultation. Prior to signing the contract, if the employer has satisfied to design work which is done by the designer, the employer shall pay the corresponding design charge. During implementation of the Contract, when the employer requests to terminate and cancel the contract, the down payment paid by the employer shall not be returned if the designer doesn’t begin the design work。 承擔(dān)本項目外國專家來設(shè)計人辦公室工作的接待費(fèi)（包括傳真、電話、復(fù)印、辦公等費(fèi)用）。 發(fā)包人應(yīng)為設(shè)計人派駐現(xiàn)場的工作人員提供工作、生活及交通等方面的便利條件及必要的勞動保護(hù)裝備。逾期超過 30 天以上時，設(shè)計人有權(quán)暫停履行下階段工作，并書面通知發(fā)包人．發(fā)包人的上級或設(shè)計審批部門對設(shè)計文件不審批或本合同項目停緩建，發(fā)包人均應(yīng)支付應(yīng)付的設(shè)計費(fèi)。未收到定金，設(shè)計人有權(quán)推遲設(shè)計工作的開工時間，且交付文件的時間順延。 在合同履行期間，發(fā)包人要求終止或解除合同，設(shè)計人未開始設(shè)計工作的，不退還發(fā)包人已付的定金；已開始設(shè)計工作的，發(fā)包人應(yīng)根據(jù)設(shè)計人已進(jìn)行的實際工作量，不足一半時，按該階段設(shè)計費(fèi)的一半支付；超過一半時，按該階段設(shè)計費(fèi)的全部支付。 9 發(fā)包人變更委托設(shè)計項目、規(guī)模、條件或因提交的資料錯誤，或所提交資料作較大修改，以致造成設(shè)計人設(shè)計返工時，雙方除另行協(xié)商簽訂補(bǔ)充協(xié)議（或另訂合同）、重新明確有關(guān)條款外，發(fā)包人應(yīng)按設(shè)計人所耗工作量向設(shè)計人 支付返工費(fèi)。發(fā)包人不得要求設(shè)計人違反國家有關(guān)標(biāo)準(zhǔn)進(jìn)行設(shè)計。 雙方委托銀行代付代收有關(guān)費(fèi)用 。 Article 7 Expenditure It is agreed between both parties that the design fee under this contract is calculated and charged according to the document (2020) Design Prices.
