Both parties mission bank to pay and collect related fees. 第九條 雙方責(zé)任 發(fā)包人責(zé)任 發(fā)包人按本合同第五條規(guī)定的內(nèi)容，在規(guī)定 的時(shí)間內(nèi)向設(shè)計(jì)人提交基礎(chǔ)資料及文件，并對(duì)其完整性 、正確性及時(shí)限負(fù)責(zé)。發(fā)包人不得要求設(shè)計(jì)人違反國(guó)家有關(guān)標(biāo)準(zhǔn)進(jìn)行設(shè)計(jì)。 發(fā)包人提交上述資料及文件超過規(guī)定期限 15 天以內(nèi)，設(shè)計(jì)人按本合同第六條規(guī)定的交付設(shè)計(jì)文件時(shí)間順延；發(fā)包人交付上述資料及文件超過規(guī)定期限 15 天以上時(shí)，設(shè)計(jì)人有權(quán)重新確定提交設(shè)計(jì)文件的時(shí)間。 9 發(fā)包人變更委托設(shè)計(jì)項(xiàng)目、規(guī)模、條件或因提交的資料錯(cuò)誤，或所提交資料作較大修改，以致造成設(shè)計(jì)人設(shè)計(jì)返工時(shí)，雙方除另行協(xié)商簽訂補(bǔ)充協(xié)議（或另訂合同）、重新明確有關(guān)條款外，發(fā)包人應(yīng)按設(shè)計(jì)人所耗工作量向設(shè)計(jì)人 支付返工費(fèi)。 在未簽訂合同前發(fā)包人已同意，設(shè)計(jì)人為發(fā)包人所做的各項(xiàng)設(shè)計(jì)工作，發(fā)包人應(yīng)支付相應(yīng)設(shè)計(jì)費(fèi)。 在合同履行期間，發(fā)包人要求終止或解除合同，設(shè)計(jì)人未開始設(shè)計(jì)工作的，不退還發(fā)包人已付的定金；已開始設(shè)計(jì)工作的，發(fā)包人應(yīng)根據(jù)設(shè)計(jì)人已進(jìn)行的實(shí)際工作量，不足一半時(shí)，按該階段設(shè)計(jì)費(fèi)的一半支付；超過一半時(shí)，按該階段設(shè)計(jì)費(fèi)的全部支付。 發(fā)包人必須按合同規(guī)定支付定金，收到定金作為設(shè)計(jì)人設(shè)計(jì)開工的標(biāo)志。未收到定金，設(shè)計(jì)人有權(quán)推遲設(shè)計(jì)工作的開工時(shí)間，且交付文件的時(shí)間順延。 發(fā)包人應(yīng)按本合同規(guī)定的 金額和日期向設(shè)計(jì)人支付設(shè)計(jì)費(fèi)，每逾期支付一天，應(yīng)承擔(dān)應(yīng)支付金額千分之二的逾期違約金，且設(shè)計(jì)人提交設(shè)計(jì)文件的時(shí)間順延。逾期超過 30 天以上時(shí)，設(shè)計(jì)人有權(quán)暫停履行下階段工作，并書面通知發(fā)包人．發(fā)包人的上級(jí)或設(shè)計(jì)審批部門對(duì)設(shè)計(jì)文件不審批或本合同項(xiàng)目停緩建，發(fā)包人均應(yīng)支付應(yīng)付的設(shè)計(jì)費(fèi)。 發(fā)包人要求設(shè)計(jì)人比合同規(guī)定時(shí)間提前交付設(shè)計(jì)文件時(shí)，須征得設(shè)計(jì)人同意，不得嚴(yán)重背離合理設(shè)計(jì)周期，且發(fā)包人應(yīng)支付趕工費(fèi)。 發(fā)包人應(yīng)為設(shè)計(jì)人派駐現(xiàn)場(chǎng)的工作人員提供工作、生活及交通等方面的便利條件及必要的勞動(dòng)保護(hù)裝備。 10 設(shè)計(jì)文件中選用的國(guó)家標(biāo)準(zhǔn)圖、部標(biāo)準(zhǔn)圖及地方標(biāo)準(zhǔn)圖由發(fā)包人負(fù)責(zé)解決。 承擔(dān)本項(xiàng)目外國(guó)專家來設(shè)計(jì)人辦公室工作的接待費(fèi)（包括傳真、電話、復(fù)印、辦公等費(fèi)用）。 Article 9 Responsibility of Two Parties Responsibility of the Employer The Employer shall deliver basic materials and documents to the designer within the specified time in accordance requirements stipulated in Article 5, and shall be responsible for their pleteness, correctness and time limit. The employer shall not request the designer to design by violating the concerned national standards. If it exceeds the prescribed time limit within fifteen (15) days when the employer delivers above materials and documents, the designer can postpone accordingly the time of delivering
