【正文】 同時，應(yīng)確定簽定協(xié)議的時間和地點，中標方應(yīng)按時派全權(quán)代表與業(yè)主簽合同，并同時遞交履約保函（執(zhí)保函）。 ? 34）業(yè)主有權(quán)接受任何投標和拒絕任何或所有投標（ Employers Right to Accept Any Bid and to Reject Any or All Bids）：聲明對因此受到影響的投標人不負任何責(zé)任，也沒有義務(wù)說明原因。 ? 31）投標文件的評審和比較（ Evaluation and Comparison of Bids）：提出量化評標方法，可不考慮物價等預(yù)期影響。 29）錯誤的修正（ Correction of Errors） ? 數(shù)字金額與文字表示不符，則以文字為準，單價乘工程量之和不等于總價時，以單價為準；小數(shù)點有明顯錯誤，以總價為準；發(fā)現(xiàn)錯誤需投標人確認修改，不改者，可拒絕投標文件。 ? 26）過程保密（ Process to be Confidential）： ? 開標后，宣布中標前，評標過程嚴格保密。檢查密封、簽署、和完整性，是否遞交投標保函。 ? 24）投標文件的修改、替代和撤消（ Modification、 Substitution and Withdrawal of Bids）：在投標文件截止日期以前，可以通過書面形式提出，但需按有關(guān)規(guī)定編制和簽署。 ? 22）投標截止日期（ Deadline for Submission of Bid）：規(guī)定截止日期和時刻。 ? 正本、副本的每一頁均應(yīng)由正式授權(quán)的投標人簽注確認，任何修改的地方全需簽署。 ? 19）標前會議（ Prebid Meeting）：解答質(zhì)詢，規(guī)定日期、時間和地點。 18）投標人的備選方案建議（ Alternative Proposal by Bidders） ? 在滿足原工程項目基本設(shè)計要求的基礎(chǔ)上，提出更好的優(yōu)化設(shè)計。保證金額可固定或按工程總額1~3%估算確定。 ? 17）投標保證（ Bid Security）：投標人按規(guī)定的格式開具的信用證（ Letter of Credit）或銀行保函（ Bank Guarantee），又稱投標保函（ Bid Bond）。特殊情況可延期，需要書面通知，投標方有權(quán)同意或拒絕，不得沒收保證金。 ? 15）支付的貨幣（ Currencies of Bid and Payment）：兩種選擇：工程所在國貨幣，列出外幣比例；或報價列出比例。 ? 14）投標報價（ Bid Prices）：工程總價格，包含當(dāng)?shù)赜嘘P(guān)稅收規(guī)定的全部關(guān)稅。 ? 11）招標文件的修改（ Amendment of Bidding Documents）：在投標截止日期前的任何時候，業(yè)主有權(quán)修改招標文件，正式通知各方，必要時可延長投標截止日期。 （ 2）招標文件（ Bidding Documents） ? 9）招標文件的內(nèi)容（ Contents of Bidding Documents）：列出招標文件的卷數(shù)、章節(jié)，也就是總目錄。 ? 7）投標費用（ Cost of Bidding）：投標方承擔(dān)一切發(fā)生的費用。此外，可對資格預(yù)審中的資料進行必要更新，當(dāng)年和今后兩年的財務(wù)預(yù)測，新承擔(dān)工程等。 ? 4）合格的材料、設(shè)備供貨服務(wù)： ? 必須源于世行規(guī)定的原產(chǎn)地國家。不屬于合同的部分。 ? 以上不屬于合同文件的部分。具有廣泛影響力。絕不允許為了壓低標價隨意廢標，再以同樣條件招標的做法。通常以下 3種情況下，業(yè)主可以廢標： ? A、實質(zhì)響應(yīng)性最低標價也大大超過投資估算（一般 20%以上），無力接受投標； ? B、所有的投標文件都不符合招標文件的要求； ? C、最終投標者過少（不超過 3家），沒有競爭性。 ? 由于合同條款一般在標書中已確定，談判余地對承包方很小。如果不按時提交，投標保函將被沒收，同時可向第 2位滿意的投標方發(fā)出中標通知書，或宣布廢標。 ? 業(yè)主向中標方發(fā)通知書（ Letter of Acceptance），寫明授標的價格、應(yīng)在何時、何地與業(yè)主商簽合同。 ? 3）決標（ Award of Contract）： ? 根據(jù)評標結(jié)果，由招標機構(gòu)和業(yè)主共同商定中標者。 ? d）其他優(yōu)惠條件：設(shè)備贈予、技術(shù)協(xié)作、專利轉(zhuǎn)讓、當(dāng)?shù)厝藛T雇傭等。 ? b）施工方案比較：工期、設(shè)備等。 ? 投標文件的初步審核，實質(zhì)性響應(yīng)檢查（ Substantial Responsiveness），報價核對。 ? 2）評標（ Bid Evaluation）：由專門評標委員會進行。 三、開標、評標、決標與簽約： ? 1）開標（ Bid Opening）：在規(guī)定的日期、時間、地點當(dāng)眾宣布所有投標文件中的投標人名稱、是否按要求開具了投標保函及報價，如果有降價信函和備選方案報價，也必須當(dāng)場宣讀。應(yīng)有專人簽收保存，開標之前不得啟封；若未按時遞交，則原封退回。可書面意見，可能修改、增刪部分內(nèi)容，應(yīng)發(fā)正式補遺（ Addendum）通知。取得業(yè)主開具的現(xiàn)場考察證明。 RECORD ? The Contractor shall submit an anization chart for the Work which identifies key personnel and the responsibilities. Resumes of key personnel shall be submitted with the anizational chart. ? The proposal shall identify the location of the Contractor?s administration and engineering offices for the Work. ?
