【正文】 Arbitration: Any or all disputes arising from or in connection with the performance of the Contract shall be settled through negotiation by both parties, failing which they shall be submitted for arbitration. The arbitration shall take place in China and shall be conducted by the China International Economic and Trade Arbitration Commission in accordance with the provisional rules of procedures of the said mission. The arbitration award shall be final and binding upon both Buyer and Seller . Unless otherwise awarded by the said arbitration mission, the arbitration fees shall be borne by the losing party.
